At the time the act was committed the person was alive so you would be charged with armed robbery and probably second degree murder unless you planned on killing the victim.

planning the murder would be premeditated, making it murder 1? how can they tell if it was really unplanned? robbing someone with a gun wouldnt make the killing premeditated? you went armed and willing and able.
