If a tax service makes a mistake... QUESTION

Long story short I went to a tax service my friend reccommended.

An old fat bitch did my taxes. I wanted to claim sales tax on 2 huge items purchased last year. She told me I couldn't since I already get a standard deduction.

Well my mom asked her tax place and they said that I indeed COULD have claimed them. Basically the old fat bitch didn't care to do extra work and only did the basic to get me out the door.

I have already filed...is there anything that I can do? Ask for my money back they charged me? Do an addmendment to my taxes? etc?
 
Sales tax for what type of items?? As far as I know IRS regs go - sales tax on items purchased can no longer be deducted.....or is it for a home business??

when did this start?

I am not too knowledgeable in the tax area, but I've heard contradicting things about this.

the items are new vehicle and new computer....both are used for business, but also partially for personal use. I have been told I can deduct both regardless and also that I cannot deduct since it is also for personal use.

Do you have a home business? Do you have your home business out of your home?? Is it a registered business??

You CAN deduct a portion of the vehicle/computer (from what I remember) that you use for your home business BUT the IRS rules governing a "home business" are VERY strict - you have to set aside an area of your home for the exclusive use of the business AND you have to be able to PROVE it. The majority of audits come from people claiming home businesses and deductions from said home businesses.

"The American Jobs Creation Act of 2004 gives taxpayers the option to claim state and local sales taxes instead of state and local income taxes when they itemize deductions. This option is available for the 2004 and 2005 returns only."

Your original tax preparer may be correct in deducting/itemizing your state/local sales tax paid INSTEAD of what you paid for the car/computer. Really is the sales tax paid on the car/computer so much that it will add more to your refund??

You're welcome! It wouldn't hurt to get a 2nd opinion....have them redo your return and see what the diff. is....if it's more than $100 on your return + the cost of the redo, then it may be worth it....
