They seem to think they can uphold it as an irrefutable document at one moment, and then turn around and say the founding fathers didn't account for this at another moment. It's very vexing.

I actually think the 14th amendment probably does need a fix but it's been so hammered into me that last 2 years that the founding fathers were omniscient oracles that foresaw 500 years into the future. Surely this hasn't changed in 6 months right? So if we needn't fuck with the constitution in the beginning of 2010 why should we fuck with at the end?







all bullshit aside...it's a shame that political fecklessness is destroying the very political and judicial process that the founding fathers tried to instill in the constitution so that we can deal with future problems. The point is you can't pick and choose those issues that you feel are sacrosanct and those that are not.
 
Kind of like how people think the 2nd amendment doesnt mean we can actually have guns?
How about this: I just dont think the founding fathers could have foreseen mass communication weapons such as the internet and television and how much unfair influence they have. We need to take another look at the 1st amendment.
 
and Dems don't understand it when it comes speech they find offensive. That's why the founders made it so difficult to change the document....and the court system is actually the hero of the three branches because they have done more more to protect our rights in the last few decades than the congress and Pres have done combined since the Constitution was ratified. As a matter of fact, the executive and legislative branches have been endeavoring to reduce our freedoms and reduce us to serfdom.

i think most politicians understand the constitution a lot better than you do

but they'd rather use it as a tool to push their agendas than to strictly uphold it

Having said that, we're stuck with it. Laws and amendments have consequences and they should have thought that amendment through back in 1868. There would have been much better ways to achieve their original goal.

cause we know only evil white repubs do this, a dem would never consider cheating taxes (rangel and waters are nonwithstanding).

I think it's constructive to look at the charitable donations our leaders are required to disclose. Repubs always give more money to charity than their Dem counterparts as a percentage of income...Barry and Joe gave a meager amount of money to charity...Barry gave most of his to his racist Marxist pastor.
 
It's all about power creep...each party tries to gain more and nobody in Washington acknowledges the enumerated powers anymore.

Let me clear something up for all of you.

The 14th amendment in terms of birthright citizenship only applies to persons subject to the jurisdiction of the United States.

ILLEGAL ALIENS CANNOT BE DRAFTED, THEY CANNOT BE CONVICTED OF TREASON AND THEY CANNOT VOTE. THAT MEANS THEY ARE NOT SUBJECT TO THE 14TH AMENDMENT.



Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Unfortunately United States v. Wong Kim Ark overlooked this glaring fact..

Its not the 14th amendment that needs to be revisited its the specific case. Slaves had regularly been drafted and were subject to treason and sedition laws.. illegal aliens are not.
 
That is why we need a new third party filled with people who believe in the Constitution and don't pander or cave in to the Reid's and Pelosi's and McCains, etc.
