LOS ANGELES, California (AP) -- Ed McMahon sued a hospital, two doctors and an investment tycoon Friday over a neck injury he has said has left him unable to work, a circumstance he has blamed for his recent money woes.


Ed McMahon's lawsuit states he injured his neck after falling down a ramp-like staircase during a dinner party.

The lawsuit seeks an unspecified amount, claiming negligence, battery, elder abuse and intentional infliction of emotional distress. It was filed in Los Angeles Superior Court against Cedars-Sinai Medical Center, two doctors, and the owner of a home where he says he fell in March 2007.

The former "The Tonight Show" sidekick claims that Cedars-Sinai and its doctors originally discharged him with a broken neck and didn't adequately conduct two surgeries. McMahon's suit states his cardiologist later discovered that his neck was broken.

Cedars-Sinai has not been served with the lawsuit and could not comment on the allegations, said Simi Singer, a hospital spokeswoman.

Also named in the lawsuit is Robert Day, who owns an investment firm and has been on Forbes' list of richest Americans in previous years, and his wife. McMahon claims a ramp-like staircase where he attended a dinner party was "unsafe" because it was poorly lit and lacked handrails.

A message left after hours at Day's company was not returned Friday afternoon.

The lawsuit gives new insights into the neck injuries McMahon discussed in a recent appearance on "Larry King Live." McMahon, 85, explained that he was unable to work as a pitchman because of his injuries -- and that is why he fell $644,000 behind on mortgage payments on his Beverly Hills home.

McMahon has had to undergo three surgeries to try to repair his neck, the lawsuit states. The most recent one was performed on July 11.

McMahon's suit includes letters mailed earlier this year to the hospital informing them a lawsuit could be filed.

"We had hoped to avoid a lawsuit, but our discussions were not fruitful and we were left with no other option. That being said, we believe our suit has great merit and we expect a favorable resolution," said Howard Bragman, spokesman for Ed McMahon.

McMahon's mounting money problems include a lawsuit against him by Citibank, which is trying to recoup nearly $200,000 it said it loaned McMahon and his wife, Pam.

He goes broke due to dumbass financial decisisons then comes out 3 weeks after he gets evicted from his house and starts suing everyone,,,, only in America.. Discuss,,, he has been working full time for 90 or so years it seems,, you would think he could have a nice home paid for.,,,

I always assumed he was a good guy.....givin people money on superbowl sunday...... Now I can see, he's just a desperate, sad man......

I agree , I guess,, he is really desparate for money I guess.... He always seemed like he was on top of it. How in the hell can you loose all of your money/ like that?
 
Your right... he will never see a dime of it. Its sad that he did not have fund managers in place to properly invest for him

My Grandmother had Alzgenimers in the 1980's and the doctors had no clue what it was. She coould not remember me, my mother or even remember her name in the end,,,,,

My grandfather passed away earlier this year with it....he became violent...I dont ever want anybody to remember me that way.
 
That's why we need tort reform.

1) Loser pays. Always, non-negotiable.

2) When you file, you must specify damage amounts. No more of this "unspecified" damages where you just go on a fishing expedition to see what you can catch.

3) When you file, you must post a bond for 10% of the amount you are suing for. Many people won't have the cash up-front, but an industry would spring-up overnight for underwriting good cases. If they lose, the winner's cost reimbursement come from the 10% bond first.

See, its not that hard. But we'll never get it done because the legal lobby has a firm grip on all branches of government.

good stuff. i think alot of other foreign legal systems implement these things. 3 would have to be highly regulated though and could cause alot of issues...i see alot of potential problems with that

Something has to get the system back into balance. The constitution was written to protect personal rights and property in both directions and now people abuse the court system. Using a lawsuit with the express intent to drive settlement in an otherwise un-winnable case is the norm with today's system. You can't really blame a company for settlements, because you can either spend hundreds of thousands (or millions) on court or spend tens of thousands paying the plaintiff off. That shows-up in the prices we pay for products and services.

That is exactly right... Frivalous lawsuits and run a way jurys have destroyed this country. They also need to get all of the lawyers out of capital hill and the government.. This is why it is so bad is because they are the largest lobbying group.
 
lol! I Love the timing. Gotta admit, when in financial problems - sue someone! And he sure took his time to find the biggest pockets to sue.

Must've taken some cues from Trump.
