Hacking someone's email---- Federal Offense????

Ok, remember my fag hag / women's clothes swap thingy that happened last week? (of course you do)

Anyway the dude came back to town and accused her of hacking his email to learn where he was going and about the other girl. (not true, she discovered it on his phone text messages and then looked in his email after he left it up)

he is threatening her with criminal proceedings for hacking his email.

of course, he would first have to prove that she really did this correct? so basically without that, he has no case.
 
LOL @ him! Email is not part of the United States postal service. It isn't a criminal offense. I would laugh my butt off at his lame threats if I were him.

What exactly "could" happen. Provided he (or anyone else) could prove that she (or another person) actually did hack into a bellsouth account?

First of all, it wouldn't be a federal offense unless damages done exceeds $100,000.

Second, most states have mistamenor laws against computer breaking and entering. They also have felony laws against wiretapping, but its generally accepted that if you are looking at stored messages instead of continuous communication that you are breaking and entering which is a lesser crime. Again, to make it a felony you'd have to actually steal or damage something valuable.

Third, the standard of proof for crimes is beyond a resonable doubt -- not a preponderance of the evidence like in civil cases. Simply have no comment and the investigation will die on the spot. Detectives call it "lawyering-up" and usually shelve the case as soon as you do that.

Fourth, no body gives a shit about hacking email. Most computer crimes detectives are covered-up with ebay fraud and credit card fraud.

And finally, most of these offenses are subject to diversion. You basically tell the prosecutor what a great guy you are and they bury the case and you don't even have to enter a plea. It's a one-shot deal, but its commonly done.

Bottom line, don't worry about it the slightest bit.
 
Well he claims that she hacked his account and printed out pictures of him and this new girl. Which of course she didn't. However, he sent those pictures to about 20 different buddies bragging about them. If they did get printed out, one of them did it.
 
First of all, she didn't break into anything.

Nothing is going to happen. Trust me.

he can't even prove she learned this from his email or text messages as she has not told him how she found out. though everyone of us knew about it. but he is convinced she hacked his email and printed off these pics to send to other people.
 
Even if she did do what he thought she did, nothing would happen. He got busted. Plain and simple.

Well so far, she hasn't said anything about reading the emails while he left it open. She hasn't said anything in regards to his email at all except she denied that she hacked into his account.

He sent her one email threatening her with Federal and Criminal prosecution over this. I am hoping he does it again or confronts her by phone or in person so then she would have cause to go and have a restraining order taken out on him.

At least I think she could. Not sure what the grounds for a restraining order are.
 
It's more to do with misuse of a computer system to access private information than hacking into his account per se.

She should report him for blackmail at having threatened her with being reported to the police if she can think of any request he might have made at the same time. I'm pretty sure that blackmail is a Federal offence.
 
Now, if she broke into his house to break into his computer, they could get her for breaking and entering his home...LOL.

Actually, guys I am belly laughing at this whole thing. Do you know how interested the cops, prosecutors or judge would be to hear this little boyfriend/girlfriend fight? LOL. I guarantee you that they wouldn't take a statement from either "victim." The only thing the cops would do would be laugh their asses off about how badly this guy was busted. I mean, really, people, back up and put yourselves in the shoes of the cops, lawyers and judges who are overworked and think of whether you would mess with this. It doesn't even fit the elements of any crime that I can think of.

He should just take his medicine and be done with it...lol.

Now if only we can provoke him a bit more to do something bad and get a restraining order. It would kill him not to be able to be inside the club the nights she is there.
 
2 years ago i hacked into verizons servers so i could read peoples texts messages. I got caught. i did not use a reloving ip address or the shit i should of. before court they made it seem like i was going to do 2 years. In the court the judge asks me why did it and how i did it. I said i did it cause i was bored and all i had to do was download a program i found searching google. Anyway i got a year probastion and a 1500 dollar fine. Scary thing through its so easy to hack into anyone pc and email even with their firewalls by norton or whatever.

LOL....I wouldn't bother with a restraining order. That shit is sort of too Jerry Springer unless someone really is in fear for their life. Don't get the courts involved. =-)

I agree with other posters here who believe there isn't shit he could do. He'd get laughed at for even trying to file a police report.

If you can get him saying "unless you do this, I'm going to do that" then you have him on exortion or blackmail -- which are usually mistemeanors unless the value exceeds a certain amount (i.e. give me $1M or else).

And yes, illegally accessing someone's computer is usually "breaking and entering" in most states. Years ago when hacking hit legislative radar screens, they passed laws that parallelled illegal access and breaking and entering laws because the legislators didn't understand computer crimes. The legal standard is usually 1) did the owner of the computer take reasonable measures to protect access to the computer (i.e. passwords, in a locked room) and 2) did the person accessing the computer have an account, username or any other duties that would give them access to the computer. If the answers to those two questions are "yes" and "no" respectively then you probably at least have a breaking and entering violation (assuming you could prove it).

More recently, they are expanding the old wire tapping laws to include computer wiretapping which is also upgrading the penalties for the offense (often shifting from a mistemeanor to a felony in the process).

this is like # 1984914149149141.11 on the level of importance for feds. The budget for prosecuting this is about $18.00/yr.
 
Basically it comes down to a question of how he can prove she did. And he can't.

The girl he met online went crazy thinking he didn't tell her anything about his "lifestyle" and asked him to leave. He didn't have the $$ to change his ticket so he called a friend from TN to come get him.

I tripped on one once...damn near broke my ankle. Some stripper used it...then threw it in the snow during a snow storm. I didn't see it in the darkened driveway.
