JUST LOOK'IN FOR SOME INFO. JUST WENT OUT OF TOWN AND STILL OUT OF TOWN AND FOUND OUT FROM A FRIEND THAT MY HOUSE WAS RAIDED BY THE STATE AND LOCAL POLICE, CUZ OF AND OLD ROOMMATE THAT USE TO LIVE WITH ME LIKE 6 MTHS AGO, THEY WERE LOOKING FOR WEED, CUZ HE USE TO SELL, AND THEY SAID THEY GOT A TIP, SO THEY PICK UP MY GARBAGE FROM THE CRIB AND WENT THROUGH IT.......AND FOUND MY DISREGARDED SYRINGES AND USED BOTTLES OF TEST AND DECA, SO THAT GAVE THEM REASON TO GET A WARRANT TO SEARCH THE HOUSE SO WHILE I WAS GONE THEY RAIDED MY HOUSE AND FOUND WHAT WAS LEFT OF MY CYCLE THAT I WAS WRAPPING UP WITH............(8 BOTTLES OF DECA AND 10 AMPS OF SUS 250) WHAT DO U THINK I'AM IN FOR WHEN I GET HOME??????? TOMORROW, MY GIRLFRIEND WHOS FOUND OUT THIS FOR ME SAID THERE WASNT NO TICKET ISSUED. IAM SURE THERE GOING TO WANT TO KNOW WERE I GOT MY GEAR FROM? I WAS GONNA TELL THEM FROM OVERSEAS AND THE WEB SITE DOSNT EXIST ANYMORE, SO JUST LOOKIN FOR ANY ADVISE????????? THANX ALOT,
 
That sounds pretty fishy,

Unless they want to do DNA testing they have nothing, tell them you had nothing to do with the items in question. Deny everything and sue them.

I don’t care for lawyers, but you should sue them for violating your constructional rights-

illegal search and seizure.
 
Other things:

- Please refrain from lengthy posts IN ALL CAPS, it is the equivalent of yelling and it is hard to read lengthy posts written in all caps.
 
You could always tell them that you got it from one of the scammers. Don't even make the attempt to talk to them without a lawyer or you are almost definitely going to get fucked. Good luck brotha.

This is quite complex.

1. Do you have a roommate?

2. How did they get into the house? Who let them in? Did your roommate consent to a search of the house?

3. Do you know what it says on the warrant? Don't say A WORD to anyone, including your friends. Only talk to your lawyer.

4. Why did they go through the garbage?


This is very important. Please state.
 
whatever you do don't go anywhere near those fucks without talking to a lawyer first.Get to a lawyer fucking fast and don't incriminate yourself,know exactly what to say,only a lawyer can tell you that.
 
This is the exact reason why I throw my incriminating garbage in to a supermarket dumpster. (I watch too much Law & Order)

I AM NOT AN ATTORNEY, but you should get one if any shit goes down, and If they were empty, they can't charge you with posession. Are syringes illegal in your locale? If so, then a paraphenalia charge may be looming. From what I understand, it is the narcotics that gets you busted for the gear (they look for narcotics and end up finding gear). Usually gear isn't a priority for law enforcement.

Well, first off, dont tell them you are going to sue them for an illegal search unless you want to piss them off. I would definitely not tell them its my stuff if asked. If you say it is, they will charge you. Deny knowing anything about it, contact a good lawyer if they charge you. If they dont, kick the shit out of your roomate and give them an assault charge to pin on ya! ;)
 
How could they go through your garbage and how can they prove it was you garbage in the first place. Where was the garbage at? Outside? If so anyone could walk past and throw something in there. they ARE allowed to search your curbside garbage without a warrant and CAN obtain a warrant from evidence found in your garbage.

I'm almost finished with Law school, so I know a fair bit about this, but this IS NOT LEGAL ADVISE (I have to say that). The police can go through your trash that is sitting outside, even if it's in your yard. The only protected area outside of the house is known as "curtilage", but there are a number of factors that must be met. The MAIN test is simply whether he had a subjective expectation of privacy, and whether that expectation of privacy is one that society is willing to accept as "reasonable". A trash can outside of your house almost certainly wouldn't pass the "society accepts as reasonable" test.

If they found syringes and empty gear bottles, that would almost certainly be enough to get a valid warrant. All that is required for a warrant is "probable cause" (a substantial likelihood), and a warrant issued by a neutral and detached magistrate, which it sounds like they had. Since they were tipped by your roomate who sold weed, and found paraphernalia, the scope of the search allowed would be almost unfettered. The warrant MUST state with particularity what they are looking for, and the scope of a constitutional search must be strictly confined to places that those items could possible be (ex. if it's for a stolen piano you can't open any dressers or drawers, etc). Since they were looking for weed or gear, well that could be just about anywhere.

They may not care about your small amount of gear, and they'll surely tell you that, but take eveyone's advise and DO NOT speak to them ABOUT ANYTHING without an attorney present. First thing out of your mouth needs to be an unambiguous, "I don't wish to speak about ANYTHING w/out my attorney present". Then they MUST "scrupulously honor" your request, and anything you say would inadmissible under the exclusionary rule anyway.

I hate to say it, but they were justified to do what they did, at least under the law. But a good lawyer should be able to get rid of this. Just don't get the name of a guy off of TV, or the biggest ad in the yellow pages, ask around and get a good lawyer. Since they didn't find much worth pursuing they may just let you go with a warning, or maybe a small fine. If you're in a big city of a small town might matter too. Good luck. Somebody read their Katz v. United States and California v. Greenwoord. I agree with what you have said. However, how they obtained initial entry into the home will be, before the warrant was issued, is critical. If it's the trash by the curb, it's not good for you.

I am also a law student, NOT A LAWYER. Anything I say here is for entertainment purposes only.

Correct me if i'm wrong, but, since they raided you because your roomate was a major dealer, and fucked you in the process, couldnt you just tell them that the gear was your buddy's? Hey, since he caused this mess, i'd fight fire with fire. Your "friend" put your freedom in jeapordy and he's responsible for this whole f'n ordeal. I would do two things:

1. Get an attorney
2. Tell them the gear belonged to your roomate.......Hey, who are they gonna believe? You or your drug-dealer roomate?

BTW.....do you have a prior criminal record? If not, you are gonna look good in all of this! Best of luck my friend!

besides unless you had a bill or document in your name in your garbage they would have not enough incriminating evidence
against you to prove it was yours in the first place. no documents, not yours. maybe you did......

First off your garbage is fare game anything they find can be used for a serch warrant. secound if they do aprouch you ask for your lawer. and every time they ask you something tell you want your lawer. REMEBER DON'T TALK TO THEM THEY ARE NOT YOUR FRIENDS POLICE CAN NOT MAKE DEALS. NO MATTER WHAT THEY TELL YOU.
 
I'd listen to two things & two things only from this post if I were you. Keep your mouth shut & talk to a lawyer. If you are really worried about it, I'd go ahead and also delete this thread. There is no real proof that the gear was even yours. All they have is techniacally a misdemeanor amount of steroids. You were not saling so it is not a felony. If worse would come to worse just tell them you have a problem and need help. I doubt that it will even come to that. You may not even hear anything about it. Lots of loop holes there.... they did not do a very organized investigation, and illegally searched your trash on hearsay which is illegal..... go get a lawyer, and whatever you do, don't talk to anyone but him or her (your lawyer).... you'll be ok. Your not a dangerous fugitive.

Hearsay has nothing at all to do with police activity. Hearsay is defined as an "out of court statement, offered for the truth of the matter asserted." It has nothing to do with police conduct or what's required to obtain a valid warrant (not to mention there are like 23 exceptions that cover almost everything). It pertains only to the rules of evidence in court. There cant even BE hearsay until there is a trial anyway. Just ask for your lawyer and they are REQUIRED to cease all questioning until he is present. The police actually didn't do anything unconstitutional from the info we were given.

Curb-side garbage usually sits in the city's street right-of-way and therefore is the city's property even though you maintain it.

the problem with that theory is that all his roommate has to do is deny the whole story! if the house is in his name its "his drugs or what ever" even if its really not! same thing with a vehecile, if a passenger stuffs something illeagel under ur seat upon getting pulled over and the cops find it and the passenger says its not his....guess what! its yours!

just deny everything and get a lawyer! sounds like an easy case to beat....
 
this whole trash on the curbside thing bothers me. could someone explain it to me in laymens terms?

i know they can do it, but it's never seemed right. yes my trash sits in my yard (not in the street). i've entered into contract with a private firm to come to my house weekly to pick that trash up.

now i read the main test is whether i have a subjective expection of privacy and is that expecation of privacy reasonable.

i park my car on city streets and think society has a reasonable expectation of privacy in the police not being able to root through your car. my car is private property, so is my trash. everything in my trash can have proven ownership. or take it a step further, is it unreasonable for society to think police can come onto your property and start looking around. be it 5 feet or 500 feet? isn't private property private? why isn't somethig like trash considered private property? i've paid for everything in it?

i've never signed anything that says if something sitting at the edge of my yard constitues my giving up my expectation of privacy. what if my car were parked next to the trash. do i then have to give up my expectation of privacy?

i know the key term here is "reasonable" but please explain it to me. this is one of those things that has always bothered me. and now that it's come up. . . . .

Just let them know that the source you received your gear from no longer exists.

Stick with that...NEVER GIVE THEM MORE INFORMATION. They will threaten the hell out of you. But if your sources web-site no longer exists, then there is nothing they can do.

OK they can look in your trash all they want because it is abandoned. In your car you have a lowered expectation of privacy and they can walk up look in the windows and see whats in there. If you have shit in there bam they can bust you. Thats the reason you can't drive naked or fuck in you car.

They had every right to search his house. They had reasonable suspicion to check out his garbage, found illegal stuff obtained a warrant and served it. Like someone stated before if the warrant was for Marijuana and Gear then they can search everydamn square inch of your house because it can be hidden anywhere. Now for a stolen car they would check the garage, back yard or anywhere else where a car can fit.

It's the game we play. Be smart. Know the law. Get an Attorney.
