No, his lawyer said he should take the plea, cuz if it goes to trial he won't be able to do anything...he says it's "not defendable."

And he says if it goes to trial, he'll get 2 years in state prison. I just don't see a judge sentencing something like that for a first offense.

guy i knew a few years ago got nailed with 1/4lb. never been in trouble before either. the case was sent to "drug court" and he ended up getting 3 years of pretty strict probation. if he broke the probation in any way shape or form, the case would be sent to court with charges of possession, possession with intent to distribute, etc. i don't think ANY of the charges were felony charges though.

so he's still battling the charges? hope he's got a good lawyer. 2 ounces...that's petty shit. a good lawyer should be able to plea bargain it down further than felony possession.

hope things work out for your brother man.
 
He won't serve a year for selling an ounce of weed... that would be highly unlikely.

Get a lawyer, he'll get probation... probably with the condition of a substance abuse program. Look... they always tell you your getting the worst to scare you into turning a rat.

Turning the rat like the guy did to him is way harsher of a scenario then getting a lawyer and fighting it and taking the probabtion. I know a kid that was faced with that choice and in the end talked to others that turned, and realized they make your life hell... it never ends, don't cooperate, piss them off the threat of jail comes back.

You're better off lawyering up and taking the probation and moving on with your life. The rat things never ends, and makes your life hard.

Thanks bro. I know people who've gotten caught with ALOT more than a couple ounces...and alot worse drugs...and they didn't get shit.

One of my friends has a rap sheet a mile long, and last year he almost beat someone to death. He was supposed to get like 3 years in prison, and he didn't end up getting shit.

This just doesn't make ANY sense to me...

My exact thoughts...but this is a year old. They've tried to get him to turn rat, and he told them to fuck themselves. He's got "the best lawyer in the area."

This is like the final decision...we're past the point where they might just try to strong-arm him into turning rat...that's why this is so confusing.

I thought the whole time the lawyer was just giving worst case scenarios, so it would look good in the end and look like he got him out of this huge mess...but it turns out this lawyer didn't do SHIT for him.
 
I had a friend that got busted for several pounds of mary-j. He ended up ratting two of his friends out (wearing a wire and getting them to sell to an undercover cop). So he ended getting off of it.

I can't remember how much he sold to the cop, but my other friend (that he set up) only spent like a month in jail and had a few years probation.

Have him find another attorney. If that is the best they can do that attorney is actually a used car salesman in disquise. Either that or he's on the DA's payroll.
 
his lawyer is lazy and wants to avoid the paperwork. i'd rather spend 1 year in court defending myself, then 1 year in jail. tell him to get another lawyer and fight tooth and nail.
