Failed drug test on probation? what now?

I failed a drug test while on probation for distribution , been clean since april no failed drug screens and I relapsed and failed a drug test for opiates , its a violation of probation. Im in college getting all A's and living on my own , I wonder what will happen? anyone?

do you have anytime held over your head?
i think it's called abeyance...that could be bad, esp for felony probation.
but with overcrowding it's hard to say how hard they will nail you.
if i were you i'd plead drug addiction and get into some out-patient counseling before your court date.
if you make an honest attempt at rehab they should go soft

Plead for mercy, tell him exactly what you said here, and seek counseling if you can't get your stupid ass of drugs even after getting bagged...Sorry to be harsh bro, life only gives you a few chances...Sounds like you have excellent capacity to succeed, why fuck it up for drugs?

you fucked up... while on probation. did you not think the courts were serious? did you not care what they ordered from you? you couldnt say no?

either you are extremely weak or you are ignorant. oh, wait.. it's a disease, my bad.

Thanks guys/girls , I spoke with my lawyer and he said the least is gonna happen is im going to lose my license for 2 years along with all sorts of meetings, which makes it impossible to commute to school without a car since I dont live on campus , I live 40 mins away. I have 2 1/2 years over my head for the person who asked earlier. Harsh or not comments/advice is appreciated, insults I could care less for. Nobody is perfect.

Thanks again

i was harsh, but thats what the judge is going to think or say... as for the dude who said "throw that in the judges face"... thats an idiotic thing to say or think. all that would do is piss him off.. hopefully this kid knows better then to piss off the judge, humility would go a lot farther in this case then anything else.

Im an idiot for saying that? Go fuck yourself.. Ive done it before, and being in school helps.. Its all in how you present yourself.. If your f*cking up, no school, no job.. yeah, the judge is going to think the worst.. If your working, going to school, tyring to better yourself, it looks alot better.. The dude made a mistake.. How is telling the judge, that im going to school and working going to piss him off? Your a moron..

You better bring transcripts of your grades to court.....because no judge is going to believe you unless you can prove it.

Otherwise....see you in 2.5 years

That would be a good idea, but I doubt he will even ask.. When I was in trouble awhile ago, the judge asked me what I was doing? I told him working and going to school. He wanted to know where and how I was doing, etc.. If your honest and sincere, he probably wont question it.. Never asked for transcripts or anything, I didnt have grades with me either. I honestly never thought to bring them.. I guess it would depend on how nice of a mood the judge was in..

Ive sat in court with friends before and some judges are way to soft..violation of probation was a big one, and most of those people just got community service, no jail time..

great job!

Depends on what your probation officer wants to do with/to you.
He/She could detain you for up to 30 days in correctional facility then have you go to violation of probaton hearing. Do you have any suspended sentence or anything silly? Most likely he/she will make you have urine exams more frequently also put you in a drug/alcohol program. You never know!

2.5 yrs?? damn
they good give that to you for a violation but i doubt they will
try to get a restricted liscense that allows you to drive to school/work
and buy a whizinator if you are gonna continue to fuck off

Those poppy seed muffins are a son of a gun.

True story, my girlfriends dad failed a drug test by eatting them. Almost cost him his job, however, he bought a dozen poppy seed muffins from the bakery and ate 2 every morning for a couple of mornings and failed a random drug test.

He proved himself by a credit card receipt and a drug screen who actually heard of the "poppy seed making you fail a drug test" thing.

Sorry to hear about what happened man.

Good luck.

be leave it or not the fact that you have 2 1/2 years over your head saves you more then it hurts you bro.see this is how it works when you have a suspended sentence.if they violate you when you have a suspended sentence the new law is they have to give you all or nothing. So this puts the judge in a spot were he has to think to him self.do I really want to give this guy a hole fucking 2 1/2 years fore falling a drug test.pffffffffft I think not.I have seen guys with suspended time of well over 5 years fore crimes way worse then yours fail "15 drug test before the judge ever even considered giving them there time.
but if you had no suspended time the judge would most likely lock you up for 30-60-90 days for falling a drug test because if you have no suspended time and the judge violates you your punishment is up to him.if you have suspended time and he violates you then you do all of the time that is suspended.

its pretty fucked up I know but thats just how the system works.

Yes but it is a state issue so where it may be that way in MA it may nbe different where he is from. @.5 years sucks but the monitoring company looks at every possible way they can squeeze another dollar out of you. In CO the courts get some of the money too. It is a business they mostly care less whether they rahabilitate you they care more about how much money they get from you. Give them reasons to get more and they will.

I think he was referring to your use of "throw it in the judge's face" as if to walk into the courtroom and getting indignant with the judge. I don tthink anyone would disagree that he should let the court know about his schooling.

are you shitting me? I only had to pay about $300 for PO and $6 ew for BA's for 6 months would have been $15/ed for UA's in CO. Oh well my debt is paid and my wallet is lighted but I would not let them break me. I did the DUI Crime and time and learned my lesson!

sell your car, buy a bicycle and get a place near campus.

Tell the judge you screwed up, get some letters from your professors stating you are a good student. Explain to the judge that you will have to drop out of school if you lose your license.

Find some kind of drug program near school and enroll now.

Otherwise, you're a junkie wasting the time of this judge.

Clean it up bro. I'd get into treatment and start going to meetings eithe way. The drugs aren't working for you and you have too much at stake

If this happened in Atlanta, you wouldn't be posting about it, they would have locked your ass down right then and there when you failed.

Probation violation you get no vacation. That is how the saying up there goes.

I dont know how relevent this will be, but years back I got charged and convicted with my 3rd DUI, which is a felony. At sentencing, my mandatory 2 year penitentiary time was suspended and I was sentenced to 70 days in jail (@ $25 a day), 2 years probation, drivers license revoked for a year (w/no work permit since it was a revocation and not suspension), complete an alcohol program, fines and court costs ($665), along with mandatory weekly AA meetings for the duration of the probation, and stay away from bars and alcohol for the duration of probation.
Well, I drank and got caught with 5 months left on my 2 year probation. This offense was technically grounds for revoking the suspended sentence and sending me down the river for 2 years. But at court, the judge gave me 18 days in jail. That was it. No extended probation time, no fine, no losing my (newly aquired) drivers license. The judge asked me if I was working, what type of work I did, and how long I worked there. So what you are doing with your life at the time of your violation does make a difference, to some judges anyway. May be different where your from, I dont know.

Hopefully, for your sake, this screw up will make you rethink everything like the way it made me do. For me, its Friday night right now, and I'm actually home sober! (and its been this way for years, now) I DIRECTLY attribute it to going through the crap I put myself through with that 3rd DUI. I'd probably still be a weekend regular heavy drinker if I didn't go through all that. Or worse.

penalizing drug addicts has prove real successful
high time we explore other options than prison for drug abuse
and who cares if he wants to wreck his body with opiates?
should be up to him, nobody should have a right to my urine sample

im so glad i dont have an addictive personality, i know when to break it off before it becomes a problem. sorry to hear your problem, hope you get it sorted out.

I did 3 years of those stupid classes, then jail, and now on probation. Complete waste of time and money, oh yeah the ankle bracelet too.

If you are seeing a shrink complain of anxiety and get a script for Xanax, don’t take it, just when testing,

It blows their tests out of the water entirely,

After four or five years of this nonsense, they hardly ever test me anymore,

They have given up.

I get a new probation officer every 2-3 months, I think they are ready to leave me alone, I am really, really tired of their nonsense.
