Ebay Mishap Update!!!

Here is the original problem from my first post:

I sold an indash LCD screen on ebay. Pioneer avx p7300 dvd. It was almost brand new. I only had it in my car for a few months. I sent it in great condition. When the guy who bought it received it he said that there were wires yanked out the back of it and he can not use it. He wants his money back. this is total BS because he probably fucked the thing up and is trying to blame it on me Those who know how ebay rules and regulations work, how can i prove that i sent it to him in working manner? What can i do? This is such BS because i know it was in perfect condition. Do i have any recourse against his false claims?

The Update:

So he sent the unit back to me. I inspected it thouroughly and came to an initial conclusion that it was not the one i sent him. Because my unit(the one i sent him) had a spring missing in the part that holds the detachable face. The one he sent back had the spring in it. Now i just need to match up the serial #'s, but i don't have the serial # for the one i bought.

Does anyone know how i can find out what my serial # was or the origin of the serial # from the unit he sent me?

Question 2: What do i do with what he sent back to me? Keep it? Im not sure what to do... But i know i am not going to give him his money back, that bastard
 
Did you send in the warranty registration card?
If you did, the mfg could look up your number for you, it may take a while though. Also, have them check on the registration of the serial number you got back, just in case someone else registered it.

Well, since you didn't refuse the package, send it back to him, and don't accept it if he sends back to you again...
 
You might be able to contact the manufacturer and find out where the damaged unit was sent (dealer) after it was made and then the dealer might be able to match up who he sold it to.

Do not send him his money back until you find out the history of that unit.

If you are absolutely certain that you are not holding the original equipment that you sent him, do not send him his money back. Verify that it is or is not the same item.

If it is not, inform him that you will not return any of the money until he sends the correct item in its original working order. Then and only then will you return the switched one and his money (less the S&H for the switched one).

Even though he deserves to have you keep everything, keep in mind that you have the upper hand here and you don't want to lose it by doing something that is outright illegal.

Dont send his shit back. He is fucking you. He probably had a broke one and is pulling this shit.
 
I'm getting sick of eBay's bullshit. I would suggest shorting their stock- they're in for a nosedive because they can't seem to get a grasp on this problem with fraud. I never had a problem before- shit, I even bought a Hummer, a 70" Television, and $5,000 speakers. But now I have had back-to-back scammers (a broken cell phone and an iPod non-delivery). I am now in the process of tracking down this clown in Hollywood trying to fuck me for $450 on the iPod.

A tip- if someone sends you a Fedex Tracking number- call to find out where it's being sent and to whom... this guy sent me the tracking number and turned out it was a letter delivered to Chicago.

Also remember that mail fraud is a felony because it's interstate commerce.
 
:light: i think the solution depends on what the problem settles down to.

1. if the problem is damage upon receipt, then read up on your shipping company's policy. most shipping rules greatly benefit the shipper and lay the onus of proof on the recipient, except that most recipients being ignorant of proper procedure for reporting damaged goods, end up out of luck because they tamper with the package without properly reporting it (proper and timely reporting of damage is essential ). shipping companies can be your friend if you read their regulations.

2. if the problem is a claim of switching, then your only defense is proof of delivery or proof that you cannot own what is claimed. frankly, you're better off pushing for shipping problems as even if you have a warranty card, the onus of proof lies on you in this scenario if the buyer wanted to be a real dick and take you to court (i always plan for the worst), you'd have a much harder time with this one. why? because even if you have a warranty card, you cannot prove (without photographic or some other evidence) that you shipped that unit; ill play devil's advocate by saying it's just as easy that he can claim you stole a similar unit (farfetched, but not impossible), and sold him that unit. simply stated, this is not an avenue you want to explore...

but if you feel the need, then your best defense is to get the serial info from your warranty registration card (i learned my lesson long ago, now im religious about this). failing that, you can contact the dealer and on rare occasions, they can either give you your serial, or give you a range of serials which can help.

other helpful things are: if you've ever sent the unit for servicing, somebody has the serial. if the guy sent you a unit, you could call the mfr or distributor and claiming you are a dealer or law enforcement, find out about the serial and it it belongs to him (or is stolen) ... this info can serve you well if you chose scenario 2 ....

Yeah i just won a prwacher curl bench for $69.00 yesterday. I sent the money an hour after the auction and the "company" that sells these has yet to give me a responce to any question I have asked. I sent about 5 e mails to get only 1 back that is so generic it looks like it is sent to everyone automatically. Since it is a business I expected them to send out the bench within a day. If they do not respond to any more of my e mails I will contact Ebay and call it fraud. No business has the right to take your money and hold on to it for days before sending anything out if they advertise the part is in stock and they claim to make shipments everyday
