DUI update: Me 1, Florida 0

Hi!

As many of you know I was arrested for DUI not too long ago. The state of Florida administratively suspends your driver's license for driving with a BAC over .08.

This is separate from the criminal proceedings, but equally a pain in the ass.

I found out today that my suspension was invalidated, so I can immediately resume driving. Woo hoo.

It also gives me a lot of leverage for the criminal proceedings, since I can use the same argument to exclude the breath test, if I don't get the arrest invalidated.

Today is a happy day.

In Florida, one has the right to appeal the suspension and appear before a hearing officer. At this hearing, you can present evidence on your behalf. The hearing officer then makes a decision.

In this case he found for me.

if i may ask, what evidence did you have? and doesn't this proccess take a whole lot of green stuff? and it ain't karma. my lawyer said she charges $2,000 just to appeal(the whole trial proccess)

the whole thing has cost me over $20,000. (Not a typo)

Evidence was largely relating to the administration of the field tests, the 20 minute observation period. I was able to prove that much of it was done substandard.

2000$ for how many hours ?

I'm not sure. she charges $2,000 to deffend you against the whole DUI jazz, then if you want to take it to trial it's another $2,000 and she doesn't promise you anything, says it can go 50/50. but i take it money is not a problem with matt.
