Say you wreck your car into a ditch..its just you..nobody else..nobody gets hurt...and u leave the scene...2 hours later the police arrest you outside a bar...can they charge you with DUI?

I would think that at that point as long as there were no witnesses and as long as you didn't admit anything to the po-lice youre cool. Seems like it would be hard to give you a DUI as long as they didn't actually catch you driving.

the question is why wouldnt you do something about your car before you went out and got drunk? That would just look suspicious. Believe me, public opinion is high against DUI's, they'd try to nail you on something.

You should have left the keys on the floor, if they question you, you could say to your knowlege that your car is at home.

No worries.

I had a buddy who was sloshed and ran his car into a telephone pole. When the cops showed up, he was standing outside his car. That's enough of a technicality for him to get the DUI charges dropped.
