DUI Charge

What would happen to a minor(16-17), if he was charged with DUI. First offense, no prior record or anything. Cost? Comm. Service? Probation? just curious.. thanks
 
Depends on what state your in. In TX you'll be put on deferred probation, about 80hrs of community service, VIP class, Alcohol/drug education class and cost without attorney fees is anywhere from $800 to $2,000. I believe the Max fine is $2,000 for a first but that would also depend on the charge. If you qualify for a court appointed attorney that will cost you about $100 if you don't an attorney will charge around $500-$800.

Did you crash? Run from the police? What happened?
 
No i didnt crash, popo pulled me over and fucked me up with every charge..dui, recklass driving, public intox, curfew, open container, few others..my parents already got an attorney but i figured if i just plead guilty then why would i need an attorney? thatd cut out alot of the cost. im fucked :(
 
One of my friends got arrested for DUI and his lawyer got the charge dropped for $500. However, the case was pretty weak against him since the police admitted that the breathilyzer machine wasn't working properly when they arrested him.
 
another thing..the police didn't take my license when they arrested me and gave it when i got my stuff so would it be ok to drive until iwent to court or not? just dont want to get pulled over(my luck) and get sent back to that shit hole.
 
In addition to what Creep said, plan on losing your drivers license for 6 months, and possibly having to spend 3 days in the pokie, or else in an off site driving class. :bawling:
 
Which state do you live in? I would call the department of motor vehicles or (in TX) the department of public safety to see if your license is valid. In TX if the cops don't suspend your license the DPS will so either way it's suspended. You still need an attorney to help you with your plea. If you just go by yourself and say OK I'm guilty they'll throw the book at you. Your attorney will be able to negotiate with the DA then go decide what to do.

If your in TX you won't due time for the first. Unfortunately, I know TX DWI laws first hand.
 
Yeah, now that I think about it, I don't think they could throw a 16 year old in the slammer anyway. Up this way you get 3 days in jail, or 3 days locked up in hotel taking a driving class for your first offense.
 
i already spent 7 fucking days in jail..that was the worst time of my life and i dont ever plan on drinking again
 
u were in lock up for 7 days for a dui?

were your parents out of town? its called bail, for christs sake

btw i have stood trial for one before...
 
yea my parents were out of town and they wouldnt let anyone else come get me, just my parents so my mom had to fly back early and get me

yea, i drove about 100 yards and the popo got me on 4thof july, i fucked up. i never drink and drive and i decide one time im going to go visit my friend i havent seen in a long time and i get fucked. this really sucks.

Yes you need an attorney, without an attorney the court system will rip you a new asshole.

Some states classify 17 year olds as adults, and since you went to jail instead of juvi, you may be considered an adult.

In the end, with lawyer fees, expect to pay 4-5 grand, and certaintly com service, expect probation for a year or 2 (don't fuck up on probation or you will be in jail for at least a month). Everything else is up to your lawyer and the judge or prosecutor. The judge or prosecutor will throw all kinds of penalties at you, but your lawyer "should" get most of them dropped or reduced.

Yes it is ok to drive. Even if you get pulled over, you haven't been convicted of anything and no penalty has put in place that says you can't drive. None may ever be put in place.

If you complete your probation and everything else, you won't ever have a conviction, just a charge. Huge difference, you will have no record, (just an arrest record but no companies really care about that), they ask if you have been convicted of anything. So behave while on probation.

I don't know the laws of other states but in TX if your are arrested for DUI/DWI you lose your license, convicted or not. When the police suspect that you are drunk/under the influence the law states that they have to give you a breathalyser test. If you refuse this test your license is suspended for 6 months, if you take the test and fail it is suspended for 1 year, if you pass well you wouldn't have gotten arrested. Once you go to criminal court the suspension can be extended but it can not be lifted. In TX driver license are mandated by the DPS and they have their own court system. If the criminal court finds you Innocent then you can file an appeal with the DPS to get your license back. They have the power to hold the suspension if they chose to. Again these are TX laws and I don't know TN laws but they may be similar.
 
So your license is suspended upon arrest??

I have never been arrested for DWI but I was under the impression that your license won't get suspended until the judge imposes the penalty when you go to court.
 
I know this first hand. My license was suspended for 6 months for refusing the test. My little sister is also an attorney, we spent countless hours trying to find loopholes to get me off so I know a great deal about DWI laws in TX.

I'm not a lawyer yet, starting in August though.
 
your are an idiot for drinking and driving and an even bigger idiot for doing it on the 4th. hopefully you lose your license!!!!
