One thing I learned is that the law can stick you with anything they want.

Innocent until proven guilty? LMAO yeah right. Unless you know somebody you can easily get screwed by the judicial system.

In TN yes you can in fact get a DUI by having a drunk person drive your car. I've had a buddy get charged with it in the past.

if you let someone drunk drive your car, and you are in the passenger seat, both parties are liable for intoxicated driving

if you are just sitting in the back seat of a car drunk and the keys are in the ignition you can be arrested for oui...the charge is not dui its oui

If you're that worried, either take the risk or don't. I can't count how many times we drove down I4 from Orlando drunker than hell with friends hanging their heads out the window while puking going 80mph. As long as you're not completely blitzed and you're not driving around 2am, odds are you will be fine.

But, as I said, it's your call whether you wanna take the risk.
