In TN, i'm pretty sure that if you and someone else are drunk, and you let them drive your car and you are with them, you both get a DUI.lilj888 said:If someone drives your car drunk while your drunk too, do both of you get license suspended? because they are driving your car?
i don't think so bro.string_bean00 said:no only the driver

if you let someone drunk drive your car, and you are in the passenger seat, both parties are liable for intoxicated driving

What I don't know is... what if you aren't drunk? I'm GUESSING you'd still get a DUI if you are with them and know they are drunk.
What if you don't know they are drunk? No idea...
What if you aren't with them, but handed them the keys while drunk? No idea...
this is how i had it described to mejh1 said:Damn that's crazy.
What the fuck if you gave your keys to someone sober and then passed out in your car, then sober person wasn't sober no more and drove you home.
Too many variables for that to be a just law.

loan your gun to somebody and they commit a felony, you may be liable
loan your vehicle to somebody and they commit a misd, you may be liable
sure i can.jh1 said:Totally different.
A licensed driver is liable for what they do in a vehicle - you're allowed to loan out a vehicle and there isn't the expectation that it will be used to assault someone.
You can't 'loan out' your gun to someone.
Moltke said:sure i can.
i can loan you my shotgun cause you said you were going hunting
the owner takes responsibility, don't argue with me about it that's the law
string_bean00 said:you guys ever do team drunk driving? the driver is responsible for speed and control while the passenger watches for lights, stop signs, other traffic, and cops.
it's stupid of course but most people have done this at some point in their life
I'm sure you can argue extenuating circumstances but you'd probably have to have an iron-clad story explaining the situation.jh1 said:Damn that's crazy.
