Do I Sue Or?

File a complaint with medical board.

1. My other half got fired as many know. One reason looking at porn at work.
2.His boss was my doctor. She sent me an e mail offering to send me porn files he was looking at if I wish. Trying to come between us I guess.
3. I sent her an e mail back stating send me nothing I am not involved.
4. 3 days later under an assumed e mail address of fagchris@.. I receive porn files. The e mail says " Chris Orlando trip" and are pictures of old fat guys.
5. I contact her attorney who is going after Chris and state I don't appreciate receiveing these files after I asked not to. He states SHE DID NOT SEND THEM
6. My attorney gets from her attoreny copies of alleged porn Chris looked at about a month ago.
7. They settle we get porn files on disc from attorney and every picture is identical to the ones sent to me.
8. I am now pissed and feel she lied to her attorney, the attorney of hers lied to me and my attorney, and my privacy was invaded.
9. It cost me $ 3,000 to defend Chris.

What should I do?

I say you chalk it up as a lose and get a different doctor. If you are sueing to cover up your litigation costs you may just incur more debt w/out a bullet proof case. Not sure if you can do anything about the files sent though b/c I don't think any laws were broken.

if they knowingly lied and misled yyou, thus costing you more money, then i think you should sue to get the money you spent on your legal costs back and a little extra for your time and effort.

but i wouldnt sue for millions claiming shit like 'emotional damages' and whatnot. that just adds to the already out of control number of frivalous lawsuits, which end up costing us all.

Unless you can prove she sent you the pics, I would not pursue it. Also, keep in mind that she had nothing to gain by sending you anything.

But why is her attorney going after Chris? Isn't being fired enough?

If they can prove he was looking at porn at work, which it appears they can, then he has no recourse as far as being fired. But I can't see what other legal action they could pursue against him.

to sue someone in order to win there has to be damages and the plaintif has to show the damages

I think it is the person who was fired was the one that suffered the most damages

think of it in a hetero way, a man gets fired from his job for looking at porn, the employer then sends the wife the pics against her will

how much did the wife realy suffer? the man is the one who suffered from the embarasment and his tarnished reputation

another thing to think about is what kind of proof did she have to be so certain that it was his porno, if she does'nt have absolute 100% proof that it belonged to him and can prove it in the court of law then that would be slander

the time tested way the legal system works is to initally sue for a large amount and settle at the last moment for considerably less.

i didn't make the system, just observe how it works.

She most likely has insurances so it wont hurt her directly....

ok, so they already settled on some type of agreement not to sue each other?
but you did'nt and you feel you've been hurt in some way, mainly the 3k you spent on an attourney?

So I think you could try and sue in small claims upto 5k and her attourney could not appear for her so she would have to appear in court herself which would cost her money
I think its only 50$ to filing fee for small claims court
and you could still file a grievance with the AMA or with anyone else

Win or lose it's worth it if it gets you piece of mind

I will be in town most of the week should you wish to have lunch. It would be my treat and we could talk about Key West and I will give you a list of great restaurants. One thing if you can wait stone crab season starts October 15th and it may be worth the wait to taste the first haul of the new season. If you have not had stone crab you're in for a treat.

Can you also please give me a call to discus the events of the disc Chris took home. At the very least I will file a complaint with the Medical Board and am also considering small claims court. The other choice if worth your time would be to split the case if we win on contingency. My understanding based on research is she can't recover attorney fees if we go to small claims court though she could counter sue me. I've thought about that and don't find any grounds of how she could counter sue as I have not done anything to her. ( unless you can think of something)

I will make it clear I am not after a large amount of money just getting back at her for the path of destruction she chose to take me down. It appears to me now Doug was lied to OR Doug lied to you as how could the disc match if she did not send it? It to me is a clear violation of what I asked her not to do. When I asked you a few weeks back you said it was best to drop everything and I did until I found the tapes to have no other porn except what was sent to me. It is very clear now that the huffing Doug did was to scare Chris as he appears to have had a case of defamation of character and I think Doug knew this. Chris now has no means to go after this after signing his letter.

On the other hand she has backed me into a corner and apparently was taunting me with her lies to her attorney and to her self. I want Doug to understand he told me " my client sent you no files" and now that is not the case. He must understand that I can take her to small claims and also file a complaint with the Medical Board which if he plays hard ball I will do. As far as I can see I have nothing to lose accept filing costs and she has much to lose including having her name given to the medical board and I will play up the [email protected] as she deals with HIV patients. That on its own could cause her to be looked at under an entire new light.

It's also very important that the entire office including the other doctors in this case know the truth of what transpired between her and I. I have no beef with the office just her. To think this was a women and doctor I held in the highest regard until she crossed the line.

I've been through extensive litigation... numerous suits... if you think you are going to gain some sense of satisfaction from this you are mistaken.

Satisfaction will be her lsoing a day from work. Money is not important to me her crossing the line is and I will act on that. Not saying I will sue but at the very least I will file a complaint.

super thought i was being creative. small claims cost me I think $ 50.00. Maybe as much as $ 300.00. She will lose patient time of god knows how many hours. If I sue for less than $ 5,000 she can't collect attorney fees from me if Imlose. She has no counter claim as she involved me and otherwise I am not involved. if she choses to bring an attroney she needs to pay his fees as well. i will not bring one to small claims court as if I lose I am out the filing cost and Chris's attorney fees which are gone already.
