Confirmed!! You Can Bring Gear From Mexico Legally!!

I think Im calm cause I dont have an idea what customs can do with me :)
I dont know but I think the only guys that would start shitting in their paints are the americans cause u guys know how tuff the law here is but I wasnt raised in the US so like I said I dont have a clue what they can do to me but in my mind they wont do nothing big. They can seize everything as long as they let me pass!

Funny, I just got a chance to answer your PM. Glad to find some people that listen for a change. If I heard one more person say I was full of shit I was gonna scream!

Told yall motherfuckers. To anyone still skeptical....DO NOT TRY THIS, THE BOOGIE MAN WILL GET YOU!!! Props for having balls there BLINGBLING. Happy growing.

And to the guy that asked about the coke and the pot...why don't you pull your head out of your ass first and see what the fuck yopu are actually trying to correlate to the other then see if you want to ask again.

Yeah, the link clearly states "only FDA approved drugs". You might be able to pass off QV as FDA approved, but I don't think they've given a green light to coke and dope yet, if you know what I mean.

This sounds great, cause it looks like i may need to head over ot Mejico soon. Now I live in So Cali, and my closest spot is TJ. Can anyone here suggest to me a good pharmacy in TJ that has a nice selection of gear at decent prices??? PM me if youd like. Greatly appreciated.

You should bump up the old thread....you got razzed pretty bad.

Bump....

You get Karma just for having the brass monkey to do it.

I'm not sure I'm eager to try it. Aside from money issues and walking away from gear for a while, you have to do it in person, and I'm not too comfortable with this part of the rules....

The United States Federal Food, Drug, and Cosmetic Act (21 U.S.C. sections 331(d), and 355(a)), which is administered by FDA, prohibits the interstate shipment (which includes importation) of unapproved new drugs. Unapproved new drugs are any drugs, including foreign-made versions of U.S. approved drugs, that have not received FDA approval to demonstrate they meet the federal requirements for safety and effectiveness. It is the importer's obligation to demonstrate to FDA that any drugs offered for importation have been approved by FDA.

If you don't have that "laundry list" of approved drugs to show your gear qualifies, you then go by the next part....

FDA has developed guidance entitled "Coverage of Personal Importations" which sets forth that agency's enforcement priorities with respect to the personal importation of unapproved new drugs by individuals for their personal use. The guidance identifies circumstances in which FDA may consider exercising enforcement discretion and refrain from taking legal action against illegally imported drugs. Those circumstances are as follows:

1. the intended use (of the drug) is unapproved and for a serious condition for which effective treatment may not be available domestically either through commercial or clinical means;

2. there is no known commercialization or promotion to persons residing in the U.S. by those involved in the distribution of the product at issue;

3. the product is considered not to represent an unreasonable risk;

4. the individual seeking to import the product affirms in writing that it is for the patient’s own use (generally not more than a 3-month supply) and provides the name and address of the doctor licensed in the U.S. responsible for his or her treatment with the product, or provides evidence that the product is for the continuation of a treatment begun in a foreign country.

Gear users can't meet these criteria. Gear's not used for a serious illness (unless you're going to lie about that). You'll meet the second issue if you do #4 by saying it's for personal use only. #3 isn't a hard matter to prove, but #4 gets you by requiring you give the name and address of a doctor in the USA. You can't meet that.

So, just keep in mind you only are protected if what you want to bring across falls under that "laundry list" of FDA approved drugs. I'm too busy to look for such a list on the FDA page. Maybe a project for someone else?

Otherwise, the game remains the same.

maybe if one of you guys has a bright lawyer they should look at it for loop holes. we could speculate all day. but I would have someone read through it.
