Carrying Guns in Texas.

My wife is going to go visit some family in Texas and she is driving by herself. So I want her to take the glock loaded(she doesn't a have a CWP) but with no bullet in the chamber. I told her to stick it in the center console. And if a cop pulls her over and ask to look in there to tell him no. I think she is still legal since she is going through more than two counties but I am not sure. What do ya'll think?
 
i can believe the way you guys act towards guns. its crazy

I think that's still true. If you're traveling through 2 or 3 counties, you can carry.
 
I hope he doesn't ask to search the vehicle, unless she has the gun in a case or Tx allows console carry.. At least in Fla thats the law for vehicle carry, and Fla and Tx are very similar in scope of gun laws..

Gun must not be easily accessable by vehicle accupants, such as in a case.

11. It is lawful to possess a concealed firearm for self defense or other lawful purposes within the interior of a private conveyance, without a license, if the firearm is securely encased or is otherwise not readily accessible for immediate use. Nothing herein contained prohibits the carrying of a firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. The exemption shall not authorize the carrying of a firearm concealed on the person.

Securely encased is defined as encased in a glove compartment, whether or not locked; in a snapped holster; in a gun case, whether or not locked; in a zippered gun case; or in a closed box or container which requires a lid or cover to be opened for access. Readily accessible for immediate use means that a firearm or other weapon is carried on the person or within such close proximity and in such a manner that it can be retrieved and used as easily and quickly as if carried on the person.

That is what I thought. And no Texas isn't necessarily that dangerous but you never know if you are going to run across a nut or something. It is good to be armed anyway especially if you are a 5'2" chick that is very good looking.

LOL but i am going to try to go slow on highway 101 but it is going to be hard.

That is the Texas law that goes into effect 9/01/05. I don't know about the peaceable journey laws until that date, make a call to the local sheriff and ask.
It is an extremely bad idea to not tell the officer that you have a loaded gun in the car if you or she gets pulled over.
Why wouldn't you have one in the chamber if you are going to carry?
There may not be enough time to chamber a round if something happens?
 
When I carry my colt 1911 .45 auto hunting or camping,
it's cocked and locked..

round in the chamber, hammer cocked fully, safety on..

A flick of the thumb on the safety is all it takes to fire..
And other than empty chamber, this is the safest way to carry it and
still be ready to fire quickly if needed.

as for your question of legality.


NEGATIVE - 100% ILLEGAL WITHOUT LICENSE TO CARRY

The clip may be loaded but must be kept in separate quarters. In other words, the clip could be in glove box, gun in case in back seat or in trunk. The two can not be stored together in same bag or in glove box or with clip in the weapon. They must be carried separately without a license in Texas.
