C-ditty and the like... Easy Law Question...

ok, we were all discussing how to get a friend into the bar earlier and i just starting wondering about this hypothetical situation..

say he gets into the bar with his fake id just fine.... after a while a man who is obviously a undercover cop comes up and asks him for id and his age or however it would work. at this point, would the person being questioned have any rights to get up and leave while remaining silent?

i'm thinking yes as it is a private establishment and he is not employed by the establishment itself

but i am not sure as i have no knowledge of the law in this aspect
 
not an attorney, but...

you're not in a private residence, you're in an establishment licensed to sell liquor by the state/county/whatever, and the police, etc. will be authorized to check compliance with the law in order to keep their license. I doubt there's any way to just get up and leave w/o getting arrested, you have to make your ID available when requested by a proper authority...
 
unless he presented a badge, stated he was an employee of the establishment, or stated he was a cop then the person has all the right in the world to leave without showing the id or speaking. If joe schmoe on the street comes up to you and asks you for ID you are by no means obligated to present it....same thing would apply here.
 
true, I'd make sure to see the ID of the person requesting it if they don't obviously work there or are in uniform. could just be a perv trying to get her name and address :)

when I've seen them do it, it's pretty obvious, at least one in uniform, asking for lots of IDs and kids running for the back door :)

The possession of a fake id is illegal. If a police officer inside a bar, and has a reason to believe that a person is underage... you can't just get up and walk away from him... regardless of whether he has SHOWN a license. If the kid asks... the guy will probably say he's an officer... An officer only needs reasonable suspicion to ask for an ID, at any time... no matter what.

If it is a private establishment... they can ask for an ID... if you don't want to show it, they can ask you to leave... or, if they REALLY want to be a prick, they can hold you until an officer arrives...

Either way... get a good fake... ;)

We used to make them with photo shop. In Oklahoma if you take someones birth certificate in and get a fake ID it is a felony. If you make it on the computer it is a misdemeanor since it isn't altering an offical document. We used to use them all the time. We would give them to someone to hold for us and if we got asked we say we gave them to someone to hold and they left. They can't do anything but ask you to leave if you don't have it on you.
 
I had an easier way. I went down to the DMV to get a liscense and wrote the wrong b-day down. And since the people working there spoke hardly any English and was dumbasses, they put the b-day I wrote down. So I was gettin' into bars at 18 and shit. Cop asked for it, showed it to him. It's a real liscense, so he can't do nothin'.


Now i'm of age and don't need it.

careful though, this is a highly jurisdictional thing...

i know in illinois a citizen can arrest on anything
above an ordinace violation...

here in the sticks...felonies and any violent misdemeanors only...

false imprisonment sux...:D

Citizen arrest??? LOL Well... I know they can on Felonies, but they have to WITNESS it in progress... same as the Misdemeanor... AND they have to be CORRECT... so if a citizen arrests you for something... and they are wrong... wwwhhoooooo doggie... they could get fined/jailed.

My statement refers to nightclubs... in Chicago. We've asked girls inside for their ID's... and they say they don't have any... most of the time, we just ask them to leave... sometimes, if they are being bitches... we will call the cops... they have the ID in their purse, and it is a HUGE fake. NOW the person they are loaning it from and THEMSELVES get charged... of course, the person they are borrowing (if any at all) will get an extra special charge on top of it.

Why go out to clubs before you are 21?? Stay at home, enjoy your youth! :)

i doubt they can charge the person who 'loaned' the ID out.

haha, a guy on my floor makes them using paint.

In my neck of the woods you can drink, drive intoxicated, murder someone while driving intoxicated while using someone elses driver's lic. as ID and while driving a stolen vehicle but if you have the right lawyer it's ok, he WILL protect you.


You may even have a restaurant opened up in your name.

Sorry dude, it's the truth. Contributing to the deliquency of a minor... even though the person is over 18, they are under 21... the age of majority for drinking.

Also, Conspiracy to commit fraud... that's always my favorite... which, would allow them to be charged with the same thing the kid using the ID was.

It's kind of moot... as alot of ID's are manufactured ... with the persons OWN picture in it... but if they are borrowing someone's ID that looks like them... well... at the clubs I used to work at, we'd take the ID and turn them in to the PO-PO... they handled it from there
