You get the headers of each email, you file a harassment suit against the idiot.
It's called a Ex-Parte.
You will file it against 'John Doe @ (List of IP addresses & Email Addresses)
Then you subpeona the owners of the IP addresses to find out the originator of the message.
He will ahve to come to your local county to respond, or loose by default.
PM me if you want help with tracking the IP.

There are cyber stalking laws in some states. Check with the NY AG's office.velvett said:Is there is formal and legal way to press harassment charges for cases such as these?
And no, this is a business related matter not a personal one.
velvett said:Well, that's it them, I will have gain 50 lbs and give up all aspects of good hygiene.
Hmmm that's a whole lot of pizza....
I don't know if I could pass up on my showers though....
Have any alternate ideas?
jh1 said:What were the contents of the emails? Anything that can pin him down as the originator?
If so, just call the cops.
BTW - it's not harassment until you have clearly communicated to him that you do not want any further contact.
Once you do that, stop responding no matter how crazy he gets.
THEN file your case.
velvett said:I brought up ethical practice regarding a client of theirs as it related to the work I was hired to do for them and for their client and she flipped out and took it to mean something else and after everyone in their office agreed with me she sent me the 1st email.
Yes, SHE was the originator last monday.
I have clearly communicated that (this morning) and prior to that I ended or business relationship (last week - wednesday).
Who do you file your case to?
He is more then just some $265 jeans and means express t-shirt!patsfan1379 said:holy how the fuck do you know this dude?!?!?!?!

jh1 said:Local county court, call the court's clerk. They will help you file the paper work - it's really a no brainer. Especially since you know the person. It should be a form that you fill out, basically two or three pages at most. They will either have to respond or loose by default.
One thing, just make sure you have a copy of your last commmunication to them - WHICH SHOULD BE IN NO UNCERTAIN TERMS:
"I wish no further contact or communication from you, James Smith, ever again."
Or whatever. Don't ever talk to them after that. Talking to them, even in response is still communication which is two way. Obviously, for a good case they would have had to repeatedly contact you after this - on several occasions.

velvett said:Is there is formal and legal way to press harassment charges for cases such as these?

gotmilk said:Nope. Only if they threaten you with bodily harm. You can only block their email.
Send him a certified letter telling the person to knock it off. Once formally warned, then you can seek out legal recourse.
jh1 said:Having clear communication that you no longer wish to be in contact helps your case, but it is certainly not a prerequisite.
It's all about wether it can be deemed harassment or not. That's at the discretion of the judge...
gotmilk said:You have to notify the person that you no longer wish to be communicated with in any form (e-mail, fax, phone, etc). Even your local police department will tell you to send a cease and desist.
velvett said:Can this be done via email or does it need to be a registered letter?
Both?

gotmilk said:The problem with email is she can play stupid. She can claim she deleted it without opening...or it hit her spam file and she did not see it.
Atleast with USPS mail, she received it. Most people rarely leave certified mail unopened.
velvett said:So what do you think if i send the email, then print them all out and send them certified as well?
Funny story, one of the MD's my ex-wife dated after the divorce was sending her harrassing e-mail's after she dumped him. Well, she comes to her ex, Javaguru, for help. I composed an e-mail citing all kind of legal mumbo jumbo along with including slightly veiled legal threats, I even cited the Telephone and Telegraph Act of 1920 something. Anyway, not a peep from him after she forwarded him my e-mail.heatherrae said:Yes. Harassment is harassment no matter the form of communication. One can be harrassed by email, mail, telephone.
mountain muscle said:Someone made up false names on yahoo im that looked like mine and made threatening statements.
The cops won't press charges without more proof than messages on a computer.
Yahoo won't give up the details because the guy who has all the info is in jail now.
The cops can't get a warrant without the info from yahoo.
The cops in my city say they can only press charges on the victim of the threats.
So now we are back to yahoo.
You're saying file a civil case and use the information to start a criminal proceeding? Salesmen are shadier than lawyers.jh1 said:Follow my instructions.
You have to file a suit against john doe @ the handles he used at Yahoo.
Then you subpeona Yahoo for that information.
They will give you the information if you subpeona them.
You can't subpeona them until you have a case filed in a court.
The cops won't do this for you, it's to petty to them.

Yes, what I said.jh1 said:What the?
I never said that.. you push forth with your civil suit, but of course you use the information you discover in the civil proceedings to press criminal case - if there was a criminal infraction.
Using one system to invoke another with more serious consequences. My best friend is a sales manager, he hates that I point out his job is about manipulating people.jh1 said:What's shady about that?

In the hierarchy of illegal acts it's a very low priority.jh1 said:I guess.
I just see it as a criminal act to begin with, but the people that are in charge of invoking the criminal system are too lazy to do their job.
There is also stuff here that is actionable on a civil level - now, of course you'd just let the criminal stuff takes it's course in a normal situation. However, since they aren't willing to do the work - you have to go after them civilly first to discover their identities.
I don't know. I just see that as using everything you got to get to the end result.
javaguru said:In the hierarchy of illegal acts it's a very low priority.
If you can manage to get a case into the system the criminal system is the best collection agency out there.jh1 said:Totally true.
ANd most likely, even after you outed them - the cirminal side still woudln't do shit.
WHich is all the more reason to press hard on the civil side -at least get an order of protection. Once you have that - if they sneeze if your general direction the police will arrest. And that's backed at the federal level...
javaguru said:If you can manage to get a case into the system the criminal system is the best collection agency out there.
It's amazing how quickly someone will come up with the 10k they owe you when faced with three years in a pound me in the ass prison.jh1 said:LOL
So True. They never give up, never give in, and they keep amazing records.
They're like the fucking Terminator.
They cannot be negotiated with.
slat1 said:This is a classic example of why everyone should keep a folder for every person they have contact with on their cpu.
Having all the emails saved is so important if you go to court.
Keeping phone records is huge too!

I can't bounce them I can only set it to be deleted upon arrival.
I sent out my final email notifying her, yahda yahda, harassment, blah blah, I will print it and mail it certified and once I know she has it I will change the settings.
I am curious to see if she responses if she does - I will know for sure she is bat shit crazy.

In her response, did she quote your notice to cease and desist all contact?
*REPEAT* DO NOT ever contact her again.
Don't send her mail, email, phone call.... if you see her turn around.
Oh.. forgot to tell you. The best defense to a harassment suit... is to file one yourself. She's probably off filing her own right now against you.

liability is with the owner of the company, if the company claims to not have control over the use, you can show harm on the part of the company..
it gets even more ugly from there..

It all depends. I know some one who was being harrassed on myspace and when she contacted the local Pd they told her that there was no way to prove that it was the actual person harassing her. A phone call would have been better. Personally I think that is all a load of Bs, because there are ways around it...From what I have heard some states are tryin to work on ways to protect people via the internet harassment issues.velvett said:Is there is formal and legal way to press harassment charges for cases such as these?
