Arrested?!?!?!

Quick question....this guy I've been training with for the past few months now got busted last night. Apparently, he wasn't thinking ( I believe him as he isn't the type to do this). He went into the grocery store with the intent of buying just a few items. He didn't take a cart and soon found himself picking up more items than he anticpitated. Long story short, he put two small items (I think a pack of gum and some vitamins) in his pocket so that he could carry more. Wehn he got to the register, he pulled out the gum, but forgot about the vitamins (value was like $10 or something)....anyways, when he was leaving, he got nabbed by store security. They issued him something called a "civil demand", where they took down his info., snapped a photo and said it would just be a fine. They didnt call the police because they understood his explanation.. His ? to me was whether this will go on his record or harm him in anyway. I didn't think so as the letter reads it's between the security company and the grocery store, as a way for them to get their money back and also the fact that there were no police called, no report, etc. Anyone have a similiar experience or know of the repercussions? Thanx in advance!
 
I doubt it will go on his record. The store will probably just make him pay for the item, and leave it at that. If they believed his explanation and did not call the cops I would not worry.

When my daughter was little she grabbed a small toy off a shelf and threw it in her diaper bag. I did not see it and never knew she did it until we were in the parking lot. I took the item back in and explained the situation, they were cool with it, and I left the item there.

Tell your friend not to worry since there was no police report. I am sure they just took his picture and info in case he was trying to steal and would do something like that again. This way they have record of another incident. Hey they gotta cover their ass right?

Tell your friend to get a cart next time. LOL
 
Thanks for the help......he was pretty upset about the whole ordeal this morning and was convinced his background info would be ruined forever......I wasnt sure what to tell him, so I came to you guys.......think it's no big deal huh?
 
How can it be placed on his record without a police filing? Without proper documentation, this incident cannot be on his official record. It may be on "CVS's" don't take checks from this guy, but he shouldn't worry
 
Thanx bro ....he was concerned because they copied down his info from his driver's license, hence his social security number, etc...........he wasnt even told not to "shop" there anymore.........weird if you ask me, as I thought the cops always came to shit like that...you know how you read that Joe Blow was arrested for stealing a carton of smokes, etc....in the paper? Just don't understand..........
 
Store security did it in case a similar incident happens again. Next time the police will likely be called. Whether the police come or not is completely up to store security. I imagine your friend wasn't black or lower class white because the cops would have likely been called.

LOL.....he's middle class.....white......not that it mattered because security were 2 black gentlemen........so, now are you saying if he was black, they would have let him go? Comn...this isnt a race thing....he was just concerned with what will happpen to him....is it possible they submit the citation to the cops afterwards?
 
friend of mine got busted for shoplifting but he was comepltly shitfaced so they called the cops and his parents

he eneded up being banned from the store for 1 year where his photo was hung and the state pressed charges against him I guess

he still managed get into good 4 year university so I dont know if that went on his record or not
 
geez........I dont think this is the same ciurcumstance....like I said, no cops, no parents, just took his info and told him a fine would be sent to him within 30 days........he's so worried about his background, because he's trying to get into the police academy.........not sure what to tell him..............
 
He stole a pack of gum? Damn, I hate theives. I remember the first time someone stole from me, when my father stole my anal virginity.

I wouldn't completely dismiss race as an issue. I've had black friends followed by store security and one guy was well dressed, middle aged, and a college professor. I've also had black friends complain that black cops have hassled them more than white cops. It's a fact of life that a well dressed person is treated better than someone perceived as "lower class" in our society. As a white male travelling on business the difference in people's attitude toward me in a T-shirt and jeans Vs. a suit and tie was dramatic. Whether the police become involved is purely a judgement call and frankly your socio-economic status does matter. It's unlikely your friend has anything to worry about, I don't see the police issuing a citation and a prosecutor filing charges in these circumstances. Store security has very limited legal rights to even hold a suspect and no power to issue a citation.

I won't dismiss it, but that's not what this post is about............and I don't want to take it that direction..........I do understand your view, and as he was coming right from the gym, he was probably targeted as soon as he step foot in the store..........hey, accidents happen, and I believe that's all this was.........I just hope for his sake that it doesn't turn into more than that....wish I knew something to tell him from someone who experienced the like......again, thanks for all the help.
 
nah he's fine. ive done that a couple of times, but the sight of my tongue hanging out of my mouth in astonishment and shame must have convinced them i was honest. dummies :evil:

I cant believe they are going to fine him for an honest mistake. What a bunch of assholes.

Other than the fine, and his pride being hurt I believe your friend will be okay.
 
If he was black or latino or white and clearly lower class the security would have been less likely to believe it he simiply forgot about the vitimins. Mistakes happen but when the law is concern making a mistake usually isn't going to be an exhaust. I like when you accidentially harm another person or property it's called criminal negligence. I love it was "your friend" though. lol.

Trust me, it was my training partner....I'd have no problem saying it was me, if it was....hell, I've walked out of stores a couple of times with shit in my hands, not even realizing what I just did......both times, it was because I got distracted (cell phone, etc.) but I wanted to know what would happen in case it would have been me..........the reason he got fined was because the law doesnt care about mistakes........however, I just couldnt understand why the cops werent called...........

I think it happens all the time and maybe the security guys were under pressure to nab more people that week or whatever.

Shit rolls downhill.

Like I said, I have too..........but just never been caught. What happened to you?
 
I've never been nabbed for the unintentional lift.

Once I went to a Kmart and pretended to try on shoes, only I put my old shoes back in the box and tried to wear the new shoes out of the store (they were the same brand). The security guys just took me in a back room and scared me and said I was banned from going to that Kmart. I was actually with my mom but she was in a Circuit City next door. She never foudn out :)
