Either its stolen jewelry or knockoffs. Its not that hard to copy their jewelry, especially the Sterling Silver stuff. And the Turquiose Bag & Box? Anyone can copy that.

Yes, that's exactly why they did it.

I can get a bunch of knockoff Louis Vutton bags off the corner of Wisconsin Ave in Georgetown and sell them on EBAY and some housewife wouldn't know the difference. They would probably shut me down before I sell a bag. But, its possible.

Counterfeit Goods, whether its software, bags, jewelry, clothing, etc., is big business.

It isn't EBAY's responsibility. Unless it is blatantly obvious. It is up to the owner of the trademark, copyright, brand name etc. to shut them down.
Tiffany's, Kate Spade, etc. do monitor sites like this and request that they be taken down. That said, a business' number one goal is profit. Unfortunately, Intellectual Property issues like this aren't high on the totem pole - unless its patents (drug companies, software, electronics). Yes, they do what is necessary, but companies always react instead of being proactive. To monitor stuff like this takes a lot of time. I believe Kate Spade has someone specifically for that purpose. I do the same kind of monitoring for my company.

No, it likely isn't refurbished. Its probably nickel or some other metal coated jewelry. They just copied the style.

Stolen and forged goods are always sold for much lower than the prices of the real thing to overcome suspicions. After all, would you pay full price to some random guy you don't know? Of course not, almost nobody would.

The fact that people would rather deal with an open legitimate business over some random shadowy-lurking character is also the reason why the 1920s bootleggers lost business so quickly to the legitimate companies once they where allowed to reopen.

The people who started Ebay sympathize with my strong support of free exchange. Meaning it is the customer's responsibility to not be an idiot.

You can also find "ghosts in bottles" on Ebay, and they allow it.

I almost bought a Descente ski jacket on EBAY when Descente announced that someone in China was selling knockoffs via a London address.

The Chinese are making knockoffs of everything..including the Louis Vitton bags mentioned above. There were $7 Billion worth of bogus Chinese Levi's jeans, Abercrombie shirts, and Nike sneakers seized in 2004 alone.

They'd hav eto buy it, look it -- then suspend the user's account. By then, he's created another one.

Tiffany can't say to Ebay "suspend this account, cuz it's in England and the price is so good".

People overseas are simply taking advantage of the legal loophole. Though buyers in the US do take the risk of it being claimed by customs for further "investigation".

Yes, they can ask EBAY to shutdown a site. EBAY has a program for Intellectual Property Owners (the VERO Program). Participants of this program can request that listings be removed.

We review certificates posted on EBAY all the time. If we have a problem with the certificate or the mentioning of our trademarks that somehow connects us to the seller (i.e., causing confusion), it can be shut down.

I met the General Counsel of another goods company, and they make requests like this all the time. In fact, one time they spotted a seller selling bags with their name but of a print they never made. They had to prove this to EBAY and the seller was shut down.

Its not just about people overseas. These goods are made here in the States and overseas. W/ regard to "taking advantage", yes, that is the case sometimes. But people know they are buying counterfeitgoods. Everyday there are tourists and residents :rolleyes: on the corners of NYC or D.C. buying 50.00 Louis Vutton bags. They know damn well those bags are not real.
