I was pro se (representing myself) and went up against this attorney......

Richard W. Schiffman, Jr.

Rick Schiffman is a shareholder practicing primarily in the Firm's Family Law Section. He advises clients with respect to matrimonial and family law.

Rick was admitted to the Georgia Bar in 1981. He is Past President of the Family Law Section of the Georgia Trial Lawyers Association. He is a member and past President of the Family Law Section of the Atlanta Bar Association, and a member and past President of the Family Law Section of the State Bar of Georgia. He is President of the Charles Longstreet Weltner Family Inn of Court and a Fellow and Vice President in the American Academy of Matrimonial Lawyers. He is listed in "The Best Lawyers in America" and is a member of the State Bar of Georgia.

In his final ruling, the judge said he saw "no proof or reason to share in the concerns of the opposing party and that over the course of the trial he saw nothing short of a very loving and caring mother and overall a beautiful person on the inside and out." He granted me sole physical and joint legal with me having the final say in any unreached agreement. He also increased his child support and ordered he take out a $1,000,000 life insurance policy for mini me in my name. He gets every other weekend visitation and thursday nights to see her.

Okay. Be honest.

Did you diddle the judge?

I told you that you would win. The only person that doubted you was yourself... and you succeeded. Time to celebrate a little...

Yeah well it's tough NOT being scared poopless when you're representing yourself in a case like this.

His attorney is very well known and respected as one of the best in atlanta. That's a lil scary for lil ol me.

i pretty much wanted to  straight for the past two days.

having to come up with and question not only my witnesses but cross examine my ex on stand. :worried:

Your right... at the same time, I saw some of your evidence/paperwork. When my friend told me that she was having a hard time coming up with advice for you, I knew you had all your bases covered. She knows her shit, and if she couldn't find anything more to advise you on, than I knew that any sensible Judge would rule in your favor. Simple as that. I just talked to her, and she said that she would have been suprised if you would have lost anything. You did an amazing job.

Then again, if I was in your position, I would have been equally worried.

He did.

be COMPLETELY honest with her about EVERYTHING!

start journaling EVERY SINGLE THING. text messages, emails, phone conversations. the GAL will be your best witness. TRUST ME!

i just got off the phone with mine. (now, former GAL) :D

I had my first meeting with her last week. I just layed it out there... about the past drug use and the fact that the girl just won't quit...

Nothing held back.

I have every email, every text message etc... anytime anything happens I put it on my calendar.

Since I WANT to share custody 50/50, I don't think it's going to be that big of an issue - but the GAL will force her to get clean.

We will both test for drugs in 90 days. So the ex now is faced with the EXACT same decision I put in front of her 8 months ago... only this time, it's not me, it's her child.

i started crying when the judge said sole physical custody goes to ms. habitualhealth.

i'll never admit that again.

how awesome is that???
i was the only child of a single mom for a few years, and even after she remarried, she was still my only real parent...

it was a tough road for her to get there, but the best thing in the world for both of us.

the hardest part of your life is over. the rest- is a piece of cake.

and we all know how much you love cake.

I hired an attorney in the beginning and he was the biggest flake. I actually had to file a complaint with the GA Bar against him. It had already cost me $8500 and i had absolutely NOTHING to show for the case. Ended up terminating the contract with the attorney due to being held in contempt of court because he lied and never filed my required documents.

An extensive 10 month litigation is not something one budgets for so i didn't have the money to start all over again.

I knew I knew the case and the facts better than anyone so I did what I had to do.

Trust me, most lawyers are SCUM. (no offense HR)

Ha!

Actually, true story....I'm on the stand.....the opposing attorney's final question to me is "Miss HH, please state for the court what attorney/firm has provided you with all the information necessary to prepare for this trial".

My response: "Actually, Mr. Schiffman, you'll be pleased to know that your firms website provides a plethora of articles (some that he had written), research and an entire breakdown of trial prep. I suppose I should be thanking you." I held up a big file with all of the articles. Check it out.

His attorney: "No further questions your honor".

Without a doubt, the most empowering experience of my life.

Cliff notes version.....never married...daughter is almost 6...dad sued me for SOLE physical and legal custody. He wanted ME to have every other weekend visitation.

GAL=guardian ad litem. This is an attorney order by the court for the child(ren) in a case. Their sole purpose is to investigate both sides and find out what is in the best interest of the child.

Not trying to give you a hard time, but I think if both parents want custody and both are good loving parents, it should be 50/50

Her father's job has required and continues to require a lot of travel. Among other major defining factors that aren't necessary to post up....the GAL, psychologist, and more importantly, the judge saw the facts and ins/outs of the situation and ruled accordingly.

ok. I figured something was up if he wanted full custody and you actually got full custody. I still think 50/50 is the way to go, but everycase is different. Anyways congrats................now that this is all over and you need to unwind, we should fuck!

dude, i was so nervous...i don't know if it was pee or sweat running down my leg. :worried:

but i never let them see me sweat. (pee?)

i was scared sheetless walking in there. i had to hold on the to podium (did i spell that right?) so no one would see me shaking.

by day two, i had ulcers lining the inside of my bottom lip. :(

Ten months of hell for ANY loving parent, especially difficult for a mother. Imagine that length of time multiplied by 7 with no end in sight.

Good for HH. She is a loving, dedicated and more than generous, very selfless parent to even co-parent with this douche. I am not posting from gut feelings but my hubby and I have talked to Ms HH at length and were made privy to several documents from all parties concerned. She busted her ASS to defend her daughter and her right to mother and the officials involved DID do their jobs as well. But in the end, it was purely a beneficial situation for THE CHILD ALONE because of ONE THING:

THE WISDOM OF THE JUDGE.

I am truly happy for you. Now perhaps you and your baby will be free to be all that you ever wanted to be... heck maybe even surpass the dreams that you haven't even had yet! :rose:

Agreed on all points. It truly was the most trying time of my life. Regardless of how awesome and confident you are in yourself as a parent...the mere threat of someone taking her away is almost unbearable.

I've been wound so tight for the past 10 months.

And yes, it's nice to know I can move forward in my career and my endeavors without worrying about every little thing I do.

AT this point, even though Ms HH is waaaaaaaaaay beyond effective and capable, she is a beautiful woman who is herself a fitness model - the very reason that the judge from hell has taken my children from me four times in 3+ years. Because NO MODEL could EVER be a good mother.... hell, dont you know that they are all whores that would drop their skivies if the price is right... Selfish whores that only care about themselves. NONE of them could EVER be good mothers.

So I will have to pass. LOL

Yeah, all the pics came out in court. While I was on the stand the schmuck would say, "miss HH, isn't it true these are pictures of you?" he'd hand me a few dozen of my modeling pics......my response, "oh yes, that's definitely me" and smile at him.

I really wanted to ask him how many times he's checked out the pics since he got involved in the case.
