what do i do i sold something on ebay &...

okay heres my situation i sent something to this guy in oklahoma (a calculator) for 90$ and i sent it out on like june 3rd and he paid thru paypal and what not...so i told him i sent it to him which i did and put my return addy on the box and its now the 23rd and whatever its still not there and this morning i get a call from a guy saying "im representing so and so"....and he talks about the situation i told him i'd try to find out as much info as possible but what should i do now i didnt get delivery conf. and it was sent reg USPO mail...

you're out the $90 bro. IF you can't prove that the product was delivered you have to refund the money.
 
Did you insure the calculator? If you did then the USPS should be the one footing the bill.

If you paid for delivery confirmation and have the receipt then you have proof that you sent it.

If you paid for a delivery confirmation notice and didn't get one then the burden of proof is on the USPS.

Check with the USPS and see if they can track it and find out where it might have ended up.
 
PayPal has often sided with buyers, and sellers can get easily screwed. As a seller accepting payment via PayPal, you have to follow all the steps of their Seller Protection Policy. If you don't, they claim the right to automatically rule against you and collect the amount in question through any means possible. Did you get insurance? If it's insured for 90, then there should be some default tracking you can do on the package. Of course, it's not likely to be good enough for PayPal. Even delivery confirmation, signature confirmation, etc...probably aren't good enough. But if you did buy some insurance, then file a claim with USPS.
 
fuck r u serious i'd have to refund this.....i have proof that i went to teh PO and sent it becuase i paid for it by my fleet debit card....theres no way i want to refund this as i sent out a calc and now im supposed to loose everything...

no delv conf was used and it was sent regular ground mail..

any1 else...

How do you know he hasnt gotten it and is trying to scam you? Fuck him, tell him to sue you. I doubt anyone is going to pay 500+ to retain a lawyer for an 80 dollar calculator.
 
I dunno,

When I sell an item on Ebay, all I charge for shipping is either basic air or ground delivery. I am only responsible for packing, and mailing the item.

If the buyer specially requests a tracking number or insurance then fine. But it costs them more for that. I also charge a couple of extra bucks for a "handling" fee for the extra paperwork.

If the item doesn't arrive, and it's not insured by the buyer then though shit. My responibility ends once I leave the post office.
 
i send everything i sell on ebay by USPS priority mail with delivery confirmation to avoid this situation........i pass on the slightly extra charge to the buyer.
 
if you don't want this kind of hassle, don't accept PayPal and/or credit cards. stick to MO/cashier's checks/etc., or even personal checks if you must. otherwise, the potential for being screwed is always there, regardless of what steps you take. and no one needs to sue you to reclaim funds, if they've used either a CC or PayPal.

i agree with the other guy its not my mistake if he wnated to make sure something he bought got there he shoulda done so...i know i shoulda done somethign too but thats his end if he wants to pay more than he can...if not than theres the risk so i loose money and a calc ....doesnt make sense...

Can you provide a receipt that you mailed it? Did you give the option of including insurance and he refused?

Worse case scenario, go by a piece of shit calculator that is broken, can work as a replacement (meets your product description) and send it to him. Can't bitch he never got the calculator, even if it's broken.

i have under paypal that this was my activity after he paid

and i sent it out costing 3.50

He didn't most likely. He DID notice that you did not use delivery confirmation and is getting over.

PayPal will refund his money on a complaint from ANY accounts you let them have access to.

You are basically out $90. You cannot pay it and take the negative feedback hit and deal with Paypal and their bullshit. As far as his lawyer calling you? Give me a break.

See if he is a lawyer. Ask his name and callback at his office and call the bar association to check.

For the future use delivery confirmation and insurance.
 
hes not a lawyer hes a kid im pretty sure i am one too...(20yrs old) however i think it was his dad that called this morning...i say BS on the lawyer thing...one more thing is that i have no money in paypal rite now which is fine and i dont mind taking a negative hit as i have many POSTITIVES AS I AM A GOOD EBAYER!!!
 
tell him to fuck off and you'll see him in court. Represent yourself and don't lose a dime. He'll be wasting more cash paying for a lawyer. Ebay is a buyer beware service isn't it?

If you use it you risk getting scammed no? Not sure what his argument would be in court?

Just research into ebay and paypals legal system. If it seems you may be at fault, and you goto court you might end up paying for the guys lawyer fees and such.

This is only an idea from me, I don't know the procedure that well. He can possibly have a lawyer represent him in your area and not even show up himself.

But then again since you are only a guy selling something on ebay, he'll probbly only be able to make a claims to the small claims court.
 
Tell him that you sent it already, and because he didn't request and pay extra for a tracking number, there is nothing more you can do for him.

Don't let some punk jerk you around. Ask him how you don't know that the item has already arrived? Ask him how you don't know he's trying to steal from you?

The world is full of assholes. You just found one of them.
