USA PATRIOT ACT and how it can apply to you...

I don't want to cause any alarm... and I'm sure this has been discussed at length by many of you, as the growing concerns of your 4th Amendment rights to privacy are being slowly and slowly diminished under the guise of the terrorist threat.

The USA Patriot Act was implemented in October of 2001 to combat just this purpose... it was ratified by Congress without much argument, and it was quickly thrown together... it did not consider any constitutional issues that may be violated by unreasonable searches (under the 4th amendment, a reasonable search requires a warrant obtained through probable cause of criminal activity).

The Patriot Act has a detrimental effect on online communications... which now can be monitored WITHOUT probable cause... as long as the suspected activity is covered in the Act... Basically, because of the need to combat terrorism, the US Government has effectually given LOCAL and Federal authorities the ability to "sneak a peak" at your e-mails.

Not to mention, the Act seems to cover things that aren't even associated with terrorism, thus making it overbroad... these things include the monitoring of people suspected of computer fraud defined as someone "exceeding the authority" of a computer used in interstate commerce... well... LOL -- shit.

Generally, a warrant is needed to search your house... under this act, they can search your home at anytime... even waiting until you aren't there (it is customary to go when the person is HOME).
Under the ACT, wiretaps, e-mail taps, etc will not need warrants, so long as the person is reasonably suspected of contributing to terroristic activities... and THIS information can be used as legitimate probable cause for a search warrant.

Here is the kicker... and what everyone HERE should be worried about.

The Media and the US Government has had a recent push saying that drugs support terrorism... you purchase drugs, you are supporting terrorism. Now, these "sneak a peak" searches can be done at anytime... without warrant. They find out you just bought 10,000 bucks of redijects... guess what... warrant issued.

To me, this flies in the face of the 4th Amendment... it is, in effect, altering it to a great degree. I understand terrorism... but to draw a phantom bridge between drug and even anabolic steroid sales and purchases to be able to obtain warrantless wiretaps and e-mail taps... it seems to be a horrendous violation of the Constitution.

Yes,this law is another bullshit law to stomp on the rights of U.S. Citizens by power hungry overzealous government officials..The whole connection to terrorism is just a way for them to sneak in through the back door(very shadily)without people taking too much notice of what they're doing.This whole thing exmplifies what happens when the government loses focus on who pays their salaries and begins to believe that its citizens are beneath them like peons.Fucking disgusting.

You know what is scary? All it takes is a Supreme Court rulling (a REPUBLICAN SC) to say that the buying or selling of drugs in interstate or international commerce is in support of terrorism... then the shit will hit the fan and the feds/cops will go fucking nuts... not only that, but you can tack on some terrorist violations and shit too...

I've said it before and I'll say it again: this country is starting to suck. I hear Mexico is nice this time of year...
 
Mexico won't be much better before too long... too close to the US... Hawaii or Alaska might be a better alternative... perhaps northern Canada... I think the Continential US might get a little dicey in the near future... however.

Is there any kind of organized effort by lobbyist and/or organizations to put an end to the USA Patriot act because of the rights the act takes away from citizens?

Is there an expiration clause on the USA Patriot act?

I remember when this act went into effect and I could not believe that the lawmakers (which we voted in) would do such an injustice to the American people by taking away our freedoms that this country is envied for.
 
Most American's are totally unaware of the patriot act and what it is. What really scares me is home land security big brother is here and watching!!!!:(

Off the top of my head I want to say it expires in 2005... but it is up for renewal... of course... not sure what the standards for that are... but the main thing is... if there still is a threat at 2005, it can probably be automatically renewed...

As for lobbyiests... I'm sure there are... but how can they take it to the supreme court??? To have jurisdiction, there must be a case or controversy... and I believe there has yet to be an implementation of the act where a 4th amendment right has been violated... no violation, no court...

And I think there was something special about the way the patriot act was enacted, some sort of secret court where the actual act itself cannot be challenged for it's unconstitutionality.
