Kind of. They can still discriminate based on race - they just have to tailor the manner in which they do it.
I find there split decisions quite reminiscent of the last split decision on this topic. If you can't use points or something similar, then how can you factor in race?
Whatever happened to the most qualified based on your scores, gpa, and letters of recommendation? Why does race have to enter into it at all?
I find that it in reality, waters down the intellectual pool in favor of a percentage of blacks vs whites, hispanics vs whites, etc.
And even with this quota system it is surprising how the balance has not been drastically altered since its inception. Not to mention the fact that quality has gone the wayside in favor of numbers.
Sad day indeed.
