Yes, but it is not so black and white, eventhough you have a right to end an encounter w/ police so long as you are not under arrest (which itself is not as cut and dry as you might think, there is more to it then just being put in handcuffs) you still must comply with police requests for basic information. The key here is to not be put in a position of having to choose between trying to exhonerate yourself and incedentally incriminating yourself or waiving your rights. The pitfalls of the 4th, 5th, and 6th Amendements are that there are many exceptions, waivers, and requirments before getting protection. It can get very complicated and it is very fact specific. Way more then can be discussed on a message board. Alot of good bros are going down and getting their lives screwed up over simple possession, and most of the time alot of the headaches could be avoided if they knew what to do. There is a lot of incomplete information going around and people should really learn what might happen and how to protect themselves if they choose to play this game.

corrrect when it comes to law it will never be cut and dry because it all comes down to either a jury (which can be swayed either way) or the supreme court and their interpretation of things....a cop can stop and talk to anyone and you can leave at anytime, this is called a mere encounter......the next is a investigatory detention and this and to do this a police officer needs reasonable suspicion and this can only last a reasonable amount of time....lastly you have the custodial arrest and at that point if they question you about what happened you need to be mirandized.........and again once you are arrested you say nothing and ask to see a lawyer, their questioning MUST stop or case dismissed..........................oh and for anyone that thinks once the handcuffs are on you are under arrest, think again, you can be handcuffed and put in the back of the car and your still not under arrest until your told your under arrest...they can use the cuffs for their own safety....and last thing you can be arrested without being cuffed and that is when you consent to the police officers authority if he says something like "hey you come with me" their was precedent for this case set, i cant remember which case it was exactly but its there........and ill end with people all state laws (state to state) are different and you should know those as well, for example PA is ALOT more stringent with things then other states when it comes to law......goodluck with everything and stay safe

Nope. Absolutely and totally wrong.

American's are under no legal obligation to incriminate themselves.

You watch way too much tv bro. You probably also think that "by law" an undercover cop has to tell you that they are a cop if you ask them if they are. I don't know about where you live, but cops here don't have to tell you jack shit about who they are, who they work for, or whether or not they're trying to bust you. In fact, most drug deals with cops here go down without incident. Then three months later you get arrested.

Another thing to keep in mind, cops lie. And if/when you go to trial it's still your word(an accused juice user/dealer) against a cop's (sworn officer of the law/civil servant, etc) word. If you have any prior arrests, it only make's the cop's testimony that much more believeable.

well a cops word isnt worth what it used to be bro, that was ruined by mark furhman (sp) when he lied on the stand and got caught doing so in a highly publicized court case....cops cant rely on their word in courts anymore, thats a fact...i think i would know...

And everyone wonders why I posted only so much information yesterday, and did what I did when they come to the door. When shit like this happens, your mind STOPS!!!!

Perhaps YOUR mind stops, but not MINE! Actually my mind STARTS.

Get a lawyer, it saved me.

How so? You handed the DEA a case on you!!! The time for a lawyer was when they were at your door owning you with their fancy badge and shiny gun. They punked you PERIOD.

If you are in my area, let me know, I will send you his contact info. He is THE BEST in the area. Expensive though so be prepared.

LOL! If anyone contacts you and gives you their real name and location they are idiots as well and you two can play scrabble together while your on intensive probation and cant go out after 7:00pm because your dumbasses put a cases ON YOURSELF!

I will say it now, YOU WILL SNITCH! 100% no doubt the DEA will dangle the charges over your head "unless you cooperate." And we all know you cooperate to the fullest. :)

The difference in me and you is, I took certain actions seriously BEFORE the busts and secured my safety. :)
If I had of, of course I did not, ordered from one of these labs the info they have on me would be 100% useless!

Speak for yourself. Not everyone folds under pressure. When DEA came to my work years ago I didn't possess 1/10th of the knowledge I have of the law that I do today and I didn't curl up in a fetal position and beg for forgiveness

How are you saved? You haven't even copped a plea bargain yet-which will likely include you spitting names of every friend/acquaintance that you have that uses juice. You're probably making a list of every screename on this board as I type as well. Lawyers are salesman-it's part of their shtick to put your mind at ease so you'll pay them big $$$ to take your case. And if/when it comes down to you actually going to trial-even with the best lawyer, you can still lose and the judge can give you the max sentence just to make an example of you.
