So what happens during a DUI?

You get arrested? Car gets towed? Taken to station, mugshotted? Sit in drunk tank? Have to call friend to pick you up? Bail out?

Friend got arrested for DUI tonight (real smart dame sigh). Wondering what the process works. I assume (real smart dame sigh) is lookin' at $2g's in fines and 30 days suspension in cali for first time.

It'll cost more than 2g's in the end.

Sure if you add attorney fees and you still wind up getting convicted (ie: u got a crappy ass lawyer).

I think dumb gogo dancing whore blew a 0.10 (0.08 is the limit). I think it's so close to the edge, it can easily be defeated in court as to whether 'she really was 0.10 and driving impaired'.

Did they do a road side breathalizer or one at tha police station? It DOES make a difference in court.
I don't know about Cali laws with that kinda stuff, but it matters in Missouri.
Plus, was she nice to tha cop or mean? That matters,2. The judges read the reports (yea, imagine that) and they are QUICK to throw tha book at lippy drunks.
 
Doesnt matter how good of a lawyer you have if you blew.1st offense your looking at around 6 to 10k by time its all over not to mention your life is gonna be extremely miserable for the 1st yr
 
My sister got a DWI a few years back in NY...blew a .09, spent the night getting processed, was arraigned in the morning and me and the parents picked her up (she was ROR, no bail). Three days later she plead down to a DWAI, which is a traffic offense, had her license suspended for three months, about about 500ish in fines and fees.

In maryland, they give a tiny slap on the wrist - alcohol classes and three-six months license suspension and less than a G in fines and fees. In VA, you're almost promised to do at least a couple of days of jail time and a year of probation.

Bottom line, it's different state to state.
 
She's retained a lawyer. He's gonna make her plead not guilty, demand a trial, fight why she was pulled over, reliability of physical roadside test, request records of breathalyzer tests, records for the cop, her driving record past 5 years (spotless), fact she was only .02 over, throw up as much doubt he can that she really was 0.10 or was she 0.07? (makes a huge difference). All he has to do he said, is put into doubt scientifically, that 0.02 of impairment. He puts together a tough enough case for the DA, many times DA doesn't even have the time and court resources for a 1st-timer, and will just settle out of court on something else (fine, speeding charge, whatever).

DA's love people who can't afford lawyers. They sped them through court with guilty pleas and throw them at the mercy of the judge. Always get a lawyer, and never plead guilty. Then big surprise, you'll be found guilty of dui :)

Things get much harder on a dui with 'agg circumstqances' such as suspended license, 3x the limit, crash, someone getting hurt, running from cops, 3rd dui, criminal history, whatever. THen it's a much MUCH different ballgame. I wanna become a lawyer :)

I know that after you get more than one DUI the fines go way up, but when I got mine here in Pennsylvania my fines only totaled $1300.00 and my license wasn't taken or suspended at all. There is a tier system that classes all DUI's. It depends on your BAC and the situation in which you received the DUI.

Oh, get this shit. I only blew 0.083. Suck ass hunh? When I got to the county jail they tested me again, like 1/2 hour later, and I was still 0.083 so something wasn't right. There's no way after that amount of time that I should have been the same BAC. And if it wasn't for the girls standing up naked in the back of the Wrangler it would not have happened in the first place. (they got arrested too)

So I guess it all depends on the state and your BAC and situation, and whether it's your first or not. Good luck man, or your "friends"
 
If i was to keep drinking yes i would get a thrid:evil:...Some people need not drink, i am one of those.

No one needs to drink, but some people need to not drink - they aren't mutually exclusive. Some can manage and enjoy moderation, some cannot. I have to give props to jay in realizing he's one of the latter. Lots don't unless it becomes an addiction (and even then many don't).
 
My second one costs me around $5,000.00 however to insure my Lexus is over $500.00 a month....now you know why I dont drink anymore.

cost me like $6k. had to take a bunch of classes etc. did community service.

I don't fuck around anymore, I'll crash or get a cab everytime.

Oh ya ,, I forgot about that shit... alcohol classes plus reinstatment fees..... I blew .08 the first time and refused the second time .. the State confiscated my car which was a paid for Taurus at the time worth $15,000.. I had to pay my attorney to go to a hearing to get that back.. so.. now I had 4 weeks of storage plus the tow bill.. fuck.. I cant even remember how much that was.. Hell , they were going to take it and sell it....
 
fuck, I'd rather sleep passed out in the alley pick3 style than get a DUI and pay fines like some of you have had to pay......oh.....and the whole putting other peoples lives in added danger....that sucks too. But ferreals......kudos to those who have learned from their mistakes. Every once in a while you hear a story on the news about how somebody with a dozen previous dui's has managed to rack up another.... That is a sad story all around.

To each their own.....Alcohol has nearly destroyed my life, so I choose live sober.


And that has happened to many peeps bro. I'm glad you stay sober and have gotten away from that.


I've never drank so I can never say from experience, but examples like yours are a testimony against the idea of drinking at all. It can destroy your life and to has been proven to do this so many times.

I am completely against drinking, but for those that do drink, I hope you do so in moderation and stay safe.

my buddy just got his first in nj...he refused any tests so they took him in and now since he refused to take any tests hes looking at an additional 7 months of his lisc suspended. He has an attorny now.

My other friend got one and said he lost his lisc for 6 months and at the end of three years....it ended up costing him over 10gs...they get surcharges of $1000 a year for 3 years as well
