We're in the process of moving out of our apartemnt and into a house. When my girl went up there to tell her that we were moving on the 30. The lady said that since we didn't give the proper 30 days notice, they'll gonna charge me for the 12 days leading up the the full 30 days. Even though we wont be there. After all the fuck ups with our maintenance guys not fixing stuff oz just fixing stuff but in a ghetto way. We had a call order in 3 times last year for our floors and they have never been fixed. If there's mold on the walls, all they do is paint over them. Our toilet started leaking pretty heavily and it took them 6 hours to get here. I don't think I should have to paid the 12 days especially when our security deposit is already yanked b/c of not giving 30 day Anybody got any suggestions

I lived in the same situation. However knowing what assholes they were you better believe I gave them the proper 30 days notice. Getting my deposit back was like pulling teeth but they gave it to me plus a few days credit since I left a few days early PLUS interest (which is required by law).

God those fuckers were assholes.

Notice to all Washington DC area residents :

NEVER live in an apartment complex owned/managed by Horning Brothers. Especially not the Heights or the Cloisters.

Everything is in the lease, including this.(probably, go check)

There is nothing you can do, unless its not in the lease.
 
On a at will tenancy -- which is anything that isn't for a specified period of time, you need to give the equivilant amount of time notice, that is the payment... in your case... 30 days.

However, you could have a constructive eviction if the conditions were inhabitial... but usually, you'd move out right away... contant flooding, moldy air... sure, but if it went to court, they'd ask you why did you stay?

In your case, you'd have to argue that you couldn't find anywhere else to live, or that the cost would have been to great to move. .. but you'd still have to move out now...

I wouldn't give them shit. They were sorry. When I was married, We had to move out of an apartment because my wife was pregnant. We gave them notice, but they said we had to pay them for the entire amount of the lease. Well, they didn't get shit. They will threaten to sue you, but it will cost them more to sue you than what they will get from you. So fuck em
