"You could see he was dead because. His body was just in a slump motion," she said. She believes the officer should not have shot the man.


"The cop moved so the guy did not hit the cop in no kind of way," she said. "He did not touch the cop no kind of way because right when he shift gears he pulled straight ahead, so how could he hit the cop."

actually, if the officer (off duty or not) personally witnesses a felony, in the case assault with a deadly weapon, he can use up to and including deadly force to stop the felon from leaving.

If he did not witness the felony assault he would not have been justified in using deadly force..
