O.K. Ryan...if captured would Bin Laden get a fair trial

A very good case could be made for putting Bin Laden on trial. I don't agree with it, but I could give you a damn good argument.
 
huntmaster hypothetically this country is founded on the right to a fair trail...innocent until proven guilty...
 
yep, and to depart from that fundamental premise of American government would be to deny our heritage, our philosophy, and our ancestors.....all men desereve a fair trial!!! Osama shouldn't be the one that causes us to erode that fundamental premise.

I play where I want 2, and yes I would love to kill and tourture that bastard...I was mainly makeing a point on the right to a fair trial...

I certainly hope he doesnt get a fair trial, Killing so many people and trying to blow up major cities isnt something somone should be forgiven for... so mhm.:D
 
High, although it would be right, I don't really think they have enough proof on him. Could not find a jury that did not know the case, and it wouldn't be fair in the first place.

Personally yes he should, and then hung. But he will never be found, and as stated before if so he will be dead.
 
Osama bin Laden should be given a fair trial.

He should then be found guilty and promptly executed.

I don't see the problem.

I have a feeling Osama won't be caught.

If he is 'killed,' I would be surprised if his corpse is his corpse..kinda like Jim Jones.
 
I'm saying they should try Osama yomamma in a military court, find him guilty, and then execute him.

If everyone believes he's guilty, what is the point of the military court? Just shoot him.

I'm not convinced they have enough evidence to convict him in a criminal court. Nor should they force us to pay for his trial.
There is some contradiction in the thinking of the administration's thinking.........If you don't want to deal with him in our system, turn him over to the International Crime Court. If they attempt to try him in a military court, expect more terrorists attacks, more kidnappings of Americans all over the world. And deaths. Be best to just shoot him, and do one of their coverups....let the Northern Alliance take the credit for finding him and killing him.

I do not want to see anymore American people kidnapped, and executed. I like to travel, and that would definitely curtail any excursions out of the US. Wait.....They can't protect us here either.......

If he slipped away from Afghanistan, I wouldn't be surprised....we have terrorists on our most wanted list from 20 years ago we can't catch.......
 
Well...considering his avowed goal is death to Americans, I am in favor of torturing him until he devolves all of his terrorist network/info. Then tie him up and let bamboo shoots grow through his body.
 
The best thing would be that Northern Alliance would kill him. Muslims killing another muslim big deal ! Otherwise a trial or his killing by US will boost fanatics around the world.... just my 0.02
 
From everything I have read I will say one thing. If the British SAS find him first he wont need a trial because he will be dead.

Apparentely these guys dont take prisoners or people alive and alledgedly make some of the different special forces in the states look like the National Guard(no offense to the nat'l guard).

I know some people are from countries here that have issues with the Brits just like some have it with the States etc, but there is no denying why the British had such an empire for 1000 plus years, because on the ground they kick major ass.

Any Americans who think otherwise because of the American Revolution ought to remember that one of the reasons the Brits lost that war was because the Americans fighting and leading it were former British Military at one point.

Well...the British used to regularly trade with the Spanish and the French for world domination.

The Navy was always Great Britains forte'.

The British tactics in the American Revolution sucked ass. But they would have won easily if they were not at war with France at the same time. The French also gave us MUCH needed support. They just didn't think it was worth it to win the war.

Good points but the part about how alot of the "new americans" being old Brit Military is true too.

The Brit special units are apparently not those anyone wants to fuck with from what I understand.
 
I'm not quite so sure that many of you are considering the risky consequences that comes when you give the EXECUTIVE branch, full authority over Justice. The Courts are much better equipped at dealing with justice through long estatblished doctrines and procedure.

If you guys prefer for George Bush to be in charge of administering Justice, so be it. But, as for myself, no way......Terrorists will not go free in federal court. Afterall, Timothy McVeigh certainly didn't. Giving the Executive branch/military over justice is turning our consitution on its head.

I'll buy some of this but it surprises me to hear you brandishing the legitimacy of the Constitution when you would like key parts of it discarded.

Timothy McVeigh couldn't afford to get off. O.J. could. Is that justice?

This is all very true but I think all major military countries sport a "special force" that is promoted as second to none. I doubt that Navy SEAL training could accomplish anything be being tougher. I'd put them up against the British special forces any day. Americans are bigger and a little stronger.

eh eh eh...I've never disregarded parts of the Constitution, I just endorse it being intepretated in more "modernesque" ways.

But, your comparison to O.J. is quite good. But there is a distinction---O.J. Simpson polarized America & thus created two camps on America---pro-OJ and anti-O.J.

Bin Laden, however, has not polarized America in any way, thus do you think its possible to find 12 pro-Bin Laden supporters in the United States of America? we know the answer is NO....unless your jury pools target American terrorists cells.

The jury on Bin Laden wouldn't be out maybe 10 seconds, even with little evidence.........The law says proof beyond a reasonable doubt, but that's a very subjective standard in the mind's of jurors. The standard of proof beyond a reasonable doubt can easily be molded to getting the result jurors want.

Yes, and more moderernesque interpretations discard parts.
