Need important help with legal problem.....

I bought a new boat 5 years ago. The dealer was eager to sell me a 5 year contract/insurance/money back guarantee program on the Johnson motor.

Here is the deal. I paid about $2000 with a 100% money back guarantee. If the motor had a problem, it would be covered under this program. If the motor had no problem, I would get all of my money back.

The motor had no problem and I sent them the form to receive my money back after talking to the boat dealer. I fulfilled the requirements that the dealer told me about.

Today I recieved a letter saying that my claim has been denied. It is a legal document and is designed to intimidate.


I almost drove up to the dealer tonight so I could meet him first thing in the morning. I am literally shaking with anger. Thought I would seek some advice first before driving up to visit him.

I am extremely anger and will not let this pass. Sometimes one has to be forceful to get results.

I can hire a lawyer who will gobble up my claim with his fees.

I can threaten the dealer and maybe get results. My boat got badly vandalized when it was in for warrantee body work. The body shop said they had no insurance. The dealer knows this one will push me too far.

Serious informed advice direly needed here. I can not say what I almost did tonight. I could not be angrier.

Thanks in advance.....I will read the input before paying the dealer a visit.

The money back guarantee was offered by a company in Washington called "Service Contract Money Back Guarantee." It is in Bellingham, WA. Apparently it is aprt of the DFS Advantage/OMC Extend............c/o Lyndon - DFS Warranty Serives Inc. in St Petersburg, FL.

He sold it, it was not his decision to keep my money though the dealer sure did assure that it would be easy to get my money back. I had a witness with me.

Just kill somebody. It will make you feel much better. All kidding aside, I would be livid. Damn crooks.
 
couldn't you pay a lawyer to arrange a legal letter threatening lawsuit? i know you said a lawyer would be costly, but wouldn't you countering him with legal intimidation work?


what reasoning did his letter give for denial?

Well he couldn't come out and say the truth, "I'm a damn crook and I never intended to honor this agreement. Now, I hope you will lose heart and not give me any trouble." Give em hell.
 
If the contract says you are to receive your money back and they are now refusing you I would think a simple trip to court with or without a lawyer could resolve the problem. Or, maybe you could just have a lawyer that practices in the field review the contract and then if it is clear you are in the right, have him/her send a letter explaining that you WILL get your money. Many of these places will *always* refuse on the first request, it is part of the standard procedures. They do this because they know a certain number of people will just blow it off and they will save a ton of money.

I agree with your logic.

I am thinking a scared dealer may make them pay. If not then a letter from a lawyer that will cost me several hundred dollars may be required.

Taking a Washington comapny to court would not be easy or cheap. Plus I would blow up long before court date.

You have no idea how close I am to doing something.
 
Hang in there bro. Doing something crazy at this point could complete reverse the situation making you the bad guy.

Although in my experience it doesn't hurt to intimidate, don't get physical. Just make him think you might.

He hit it on the head. Just saw a case a yesterday were some moron paid an atty a 1,500 dollar retainer and then another 1,500 for further legal work on a case that was worth only 5,000. If this is only about 2,000 go to small claims court. The rules of evidence are alot simpler and non-atty friendly.

THe filing fees are usually alot cheaper as well. I dont know were you live and what the rules of the small claims courts are but they are pretty uniform around the country.
 
Small claims is a good thing to try of a couple grand--we use it now and then for my job. sometimes it works and sometimes it doesn't. The good thing is that (in my neck of the woods anyway) if you serve someone and they do not respond, you win by default. Automatic victory and no court time. The bad thing about this is that even though you've won, its up to you to figure out how to collect; the courts won't do it for you.
