My home will finally be finished Friday

The final coating of interior paint is going on today, the crown molding will be done tomorrow. My new furniture and rugs which spent the last two months in storage is being delivered Friday. The only thing left is getting my tv and rearranging everything. Then I will have a home again.

The final price of the second contractor to do ALL the work? $6100. He quoted me $5600 but had to spend the first three days tearing apart all this mess the last contractor left. He passed every single inspection the first time around.

Why didn't I find this guy earlier?
 
Cool. Keep us informed on the law suit though.
 
glad to hear the nightmare is almost over for you. how about posting some pics when everything is in position?

I have already filed the motion and the first contractor was served his papers. He has to appear at the first of Feb. on an "accountability" appearance. Then he/I will be given a court date.

In the prelim statements, I am asking for $30K for out of court settlement.

You won't believe this.. but the contractor who finished this job, when he walked in to give me an estimate... he looked around and said "oh you used Steven Zinn didn't you?" I was like "how did you know?" He told me that the last EIGHT jobs he finished were from people who fired Steven since August. He goes.. "oh, I know this man's work. Because I end up having to fix it all." So in addition to my pics and video cameras, the new contractor took pics as well so he and the electrician that Steven used both said they would go to court for me.
 
Great news, aap. I know that will be a load off your mind!

Nothing like siting in your chair, in front of your tv, in your den, in your house...
 
Well he is at least building a solid reputation.

Yeah... but it served it's purpose. I have had about 20PM's from him getting very detailed info. More info from him than the thread would have generated on it's own.

If I send you a PM and it doesn't come through, I am coming over there and leaving a dildo in your coffee cup.
 
The public rooms in my house have crown molding, and I'm thinking of putting it in the bedrooms when I repaint.
The ceilings have popcorn. You too ?
Are they having to scrape the popcorn off the outside edges to put in the crown molding ?
I'm afraid of scraping off 2 inches of popcorn around the edges and whole patches of it come crashing off the ceiling.

So what stops your first contractor from declaring bankrupcy and getting out of all these judgements?
 
I used an orange peel texture on my walls and ceiling. No popcorn. You can actually get something that you spray on and it "melts" the popcorn in that area. Not sure what it is called.

A lot of contractors when in trouble like this.. they simply declare bankruptcy and/or move their assets to another company. Which is why you go after them AND their insurance/malpractice company. No matter where they go, that insurance company will follow them.

Not certain about the laws specific to your state but it probably depends on the guys assets and how his business is set up as far as how easy/difficult it would be for him to declare bankruptcy.

Yeah, a lot of it depends on what he used as collaterol to start his business and secure his malpractice insurance.
 
About time you got your place done. What a nightmare it must have been to have the last guy come in and destroy your place only to make it worse. Hope you get him in court for the damage and fraud he tried to pull on you.
 
Actually in FL, the courts have a predetermined amount you receive. I was surprised/happy to learn this. They take :

The amount you paid
The amount of the final bill of goods
The amount of damages
The amount of legal fees

add it up to one lump sum and multiply it by three. This is the equation used in all contractor disputes.

So far, I have not paid him anything because I refused to take the final bill of $27,200 out of his hand. But I did pay for :

the sliding glass door that he busted. $1800
The tile that he broke. $28 per tile at 24 tiles. $720 (tax and delivery)
The monster cables that lasted overnight before he pulled them out of the ceiling and cut them up in order to tie down loads in his truck - $700
The liquor that his two teenage assistants drank - $160

My damages include the $3000 for the new pool pump and filter system that the broken glass destroyed.
The service to clean the broken glass out of the pool - $650
The HDTV that he took home with him - $3000
The old office desk he took home with him - $1500
The two months storage rental I have because of his slow ass - $700
The $6100 that I had to pay the second contractor to finish the job.

My legal fees are only $2000.

Add this up and multiply by 3 and you get almost $61K. Poor guy better take the settle out of court option.

Oh yeah.... the original quote was $7000. He said that he would give me $3000 for the TV, $1500 for the desk and I would just give him a check for the remaining $2500. Since the rooms had to be emptied, he took the TV and desk with him on the second day.

This Friday when I get most of my furniture moved back in, I will take pics and upload them to Ofoto and send out email invites again.
