Maternity Leave...

How many companies still do paid leave...My s/o's company is the absolute worst...the didnt pay nor pay for her benefits...and to boot they hassled her for the money and threatened to cancel the benefits on her...cause thats the first thing on your mind when you first have a baby...RRRRIGHT...and worst of all she was promised a promotion a year ago and clearly stated to her boss that if they were going to promote her she would come back early..and they gave it to someone else and stated to her that it was because she just had a baby and didnt think she could handle it...
 
That Sucks...

She should bust in there and kill some people and then blame
postpartum depression.

Also sounds like she should have read the companies Employee handbook,
Benefits section..

HIRE AN ATTORNEY! Sounds like she has an excellent case to sue them.
 
Oh wait. He isn't in America? Oh well, I don't know what the laws are like in other countries.
 
You are required as a company to give 12 weeks of unpaid leave under the FMLA laws....

Call an attorney who does nothing but employment law. It isn't my area of practice, but I think she has a case.

then she should leave. was she not aware of the parameters of her FMLA (assuming it is FMLA)

Did they really say that to her? Lawsuit!

I work in human resources, saying that is a huge mistake.

Yep. That was the part that raised bells and whistles for me too.
 
damn... with the old law, my wife got:

6 weeks before the delivery
8 weeks after

all paid for at full normal salary

with the new law, she gets

same 6 + 8 weeks paid in full

AND

if she so decides to do so up to 1 year to take care of the baby while receiving 66% of her salary.

not a bad idea, if you ask me...
 
ill look into it...as i stated nothing is in writing and i know this is going to be a problem...cause when and if its investigated...stories wiill be changed..she cant quit...we have a mortgage..car payments..and a baby to take care of...they were letting her take off 12 weeks unpaid..but the 1200 a month she got from the state didnt even cover their health benefits
 
There's nohing in the law about "paid" maternity leave. You can have maternity leave and keep your medical benefits but you still have to pay your premiums.

I know by law thye dont have to pay premiums..but its fucked that they didnt...

Then why is she working for them ? I mean if they suck she could have worked somewhere lese no ? No one forced her.

And I understand why they gave the promotion to someone else. i mean why give it to someone that will leave for xx months when there's another one that will take full benefit of it and work his ass for you...

Nothing personal, just business.
 
$50 and 4 of my pubic hairs says that none of this was in writing,
so a lawsuit wouldn't go far IMO. Even if Matlockrae was counsel

And you were amazed at why stuff was cheap over here.

As i stated 6 times above...its not in writing thats why i asked the question...had it been in writing it would have been in the lawyers hands before she got home from work that day

Doesnt mean she's good or bad. Just that she took a decision and must assume the decision. The others shouldnt pay cause someone decided to leave for a while. It's very opportunistic but that's the way it is.
