I was just sitting here with nothing to do so I thought I would ask this question due to the fact that Im dealing with the BS right now
I Live In NY and we have a point system for out licence. I recieved 2 speeding tickets in a 2 year period and now they are taking away my licence.
We cannot get over 11 points on out licence. So here is the deal:
1st ticket: 8 Points - Pleeded Guilty
2nd Ticket: 6 Points - Pleeded Not Guilty Than Pleeded Guilty (Ill explain)
Grand Total: 14 Points
Ok so here is the question:
When I got the 2nd ticket I pleeded guilty knowing i was going to lose my licence. After I did that I took a 5 Hour course which takes of 4 points of of your licence. This should leave me with a grand total of 10 Points which means I am 1 under the limit. Now I moved so I missed my cour date so I ended up pleeding guilty anyway due to the fact I thought I was ok because of the 5 Hour Course. A few weeks later I get a letter from the NY DMV stating that I am losing my licence for a minimum of 6 months!
I know that when you pleed guilty or are found guilty they go from the date of the ticket and that might cancel out my 5 hour course but shoudnt it do something? I am now going inot the DMV and asking if I it counted and took points off of my licence. This could be a loop hole but I am not sure. How can they not take points off of your licence if you were not found guilty yet.
So Ill go over it one last time:
1. Got ticket which would put me over 11 points (14 points)
2. Pleeded not guilty and Took 5 hour course
3. This should have put me at 10 points (saftey zone)
4. I Pleeded guilty due to some complications
5. Now I have my licence being taken from me even though i took the course
6. Even though I got my ticket before the 5 hour course it should count due to the fact that i stalled being guilty and than took a course to take off 4 points.
You guys think this is a loop-hole and maybe if I go into the DMV with proof of the 5-Hour course I can maybe get out of this or get a shorter suspension?
