Legal question.

I was told to come on a fitness site to ask this.

So my health insurance company lost my whole family's personal info, such as SS#, medical history, adress dob etc... Everything. The company is paying for 2 years of credit fraud protection for the whole family.

Is this enough protection? Umm, NO. I think we should get more than 2 years. Maybe 10 would make me happy. Could this be class action lawsuit eligilbe? It seems to have happened to many people. They lost computer files. I think by the wording of their letter, a laptop with this info was stolen. How does one go about getting more protection, and or involving others to join in some kind of help with the issue?

I don't want money or anything, I just want to make sure we're protected after our info has been out there now.

odds are the laptop was just lost or stolen by some retard who isn't going to know where to look or what to do with the information if they even found it.

2 years isn't enough, you should demand more.

Problem with a lawsuit is that you haven't experienced any negative effects from this yet.

Say someone eventually does steal your identity or something, then yes, sue the fuck out of them. But right now nothing has happened to you.
 
the threat of all the bad publicity (especially if this has happened to others) should be enough to get things straightened out without going to court.


you think they want potential new customers knowing how careless they are with their customers information?

I pulled my credit report

SEVERAL collections in my name at hospitals no one in my family or myself has ever been too....with names listed as aliases Ive never had/arent even close to my name (maiden or otherwise)
I'm super pissed about this because I have clean/good files otherwise

theres a medical info file like a credit report...lemme see if I can find the link
you have to pay for it though (like 8 bucks?)
they somehow get around being free under FCRA...perhaps because it isn't actually credit
from what i understand theyre extremely easy to get info corrected on though, theyre a little more ethical

Wow, that tells me it's a bit more than just someone stealing a laptop. Do you remember the name of the place I can get that info?

This happened to my wife and daughter a while back. Now my son and I get a letter for the same thing. I have to check my wife's file to see if anything happened yet, as her info was stolen before mine.

I reccomend creditchecktotal if you want to check all three reports daily
or truecredit because its more user friendly for a one time all three pull

Wow, the first thing they ask for is a SS# and the whole questioning process is automated. No live person. Hmmm, I'm not sure what's going on here. Is this a government agency?

"High call volume... will take 1 month for a reply..." wtf?

So, a company loses all their records of their customers because "a laptop" was stolen....wtf they run their whole business with a friggen laptop? Sounds like bs to me. A real health insurance company would have an encrypted database with everyone's records and someone stealing a measly laptop wouldn't have mattered in the slightest.
After this is over I'd look for a new provider.

Let me clarify. I assumed it was a stolen laptop by the wording they used in their letter to us. They never said it was a laptop. I don't have the letter handy, but it doesn't mater...

They also did say that it was encrypted and extremely difficult to view the contents of the data, but it was possible.

My only issue is having 2 years worth of fraud protection, if it is indeed in the wrong hands. I was thinking we should have more than 2 years. Not sure where to start asking for more protection. I thought contacting a lawyer would circumvent many headaches.

Now that I think about it, we got a call from a Collection Agency last week. I didn't answer the phone and they left no message. I found out who it was by the caller ID/ and a search . I wonder if we have some medical bills piling up somewhere. lol Ummm, NOOOO!!!!


I highly doubt I can call customer service and say "Hi, can you give me 5 years of fraud protecion? Thanks so much.." These people won't listen to "the little guy".

Wasn't there a number to call w/ question on the letter?

Call that number, escalate it to a manager position, demand more fraud protection. It's worth a shot.
 
As pointed out by Chewyxrage and Flex229, no damages yet = no case. This is one of those things that happens in life, and at least they told you about it. Just watch your credit record, which we should all do anyway, and report anything wrong immediately, in writing, to the credit bureaus. I'm sure the laptop was taken by a petty thief, who will probably just sell it for drug money... Never to fall in the hands of anyone capable of accessing or using any credit data. You have a way bigger chance of being defrauded by a dishonest restaurant employee or an online purchase, than from a company allowing a laptop with your info to be stolen.
