Bros or ladies out there are in the legal field, I have a question for you:

If someone made a death threat over the phone, what criminal and/or civil grounds would there be to prosecute or sue?

I don't want to take up board space with all of the details, but I will say this:

a. They made a racist comment within the threat
b. The threat was against someone's life. ie. it wasn't "I'll kick your ass" kind of threat.
c. The threat was this, "If he's not careful he'll find his nigger ass hanging from a tree."

I don't know if there are civil and criminal grounds or just one. Anybody who can clue me in, I would appreciate it.

I'd say he just committed a 5 to 10.

That's 5 to 10 minutes you beating his ass.

Actually with the new homeland security you can really fuck someone over for doing this stuff. Its now considered terrorism.

The racist comment has no real importance in either civil or criminal proceeding.

If this person was really threatened, he could get a restraining order. In some counties in some states when you get a restraining order the police will arrest the person. That should piss him off. But otherwise there isnt much you can do. Even if you taped it, you wouldnt have much to work with.

you have to remember people beat the crap out of people and get caught and still only spend less than a day in jail.

As for a civil suit, you wouldn't have much either.
