Bush says feds can open mail without warrant

WASHINGTON — President Bush quietly has claimed sweeping new powers to open Americans' mail without a judge's warrant.

Bush asserted the new authority Dec. 20 after signing legislation that overhauls some postal regulations. He then issued a "signing statement" that declared his right to open mail under emergency conditions, contrary to existing law and contradicting the bill he had just signed, according to experts who have reviewed it.

A White House spokeswoman disputed claims that the move gives Bush any new powers, saying the Constitution allows such searches.

Still, the move, one year after The New York Times' disclosure of a secret program that allowed warrantless monitoring of Americans' phone calls and e-mail, caught Capitol Hill by surprise.

"Despite the president's statement that he may be able to circumvent a basic privacy protection, the new postal law continues to prohibit the government from snooping into people's mail without a warrant," said Rep. Henry Waxman, D-Calif., the incoming House Government Reform Committee chairman, who co-sponsored the bill.

Experts said the new powers could be easily abused and used to vacuum up large amounts of mail.

"The [Bush] signing statement claims authority to open domestic mail without a warrant, and that would be new and quite alarming," said Kate Martin, director of the Center for National Security Studies in Washington.

"You have to be concerned," a senior U.S. official agreed. "It takes executive-branch authority beyond anything we've ever known."

A top Senate Intelligence Committee aide promised a review of Bush's move.

"It's something we're going to look into," the aide said.

Most of the Postal Accountability and Enhancement Act deals with mundane changes. But the legislation also explicitly reinforces protections of first-class mail from searches without a court's approval.

Yet, in his statement, Bush said he will "construe" an exception, "which provides for opening of an item of a class of mail otherwise sealed against inspection in a manner consistent ... with the need to conduct searches in exigent circumstances."

Bush cited as examples the need to "protect human life and safety against hazardous materials and the need for physical searches specifically authorized by law for foreign intelligence collection."

White House spokeswoman Emily Lawrimore denied Bush was claiming new authority.

"In certain circumstances — such as with the proverbial 'ticking bomb' — the Constitution does not require warrants for reasonable searches," she said.

Bush, however, cited "exigent circumstances" that could refer to an imminent danger or a long-standing state of emergency.

Critics noted the administration could obtain a warrant quickly from a court or a Foreign Intelligence Surveillance Court judge, and the Postal Service could block delivery.

But the Bush White House appears to be taking no chances, national-security experts agreed.

Martin said Bush is "using the same legal reasoning" as he did with warrantless eavesdropping.

reading that closely it says that they can only open it in "exigent circumstances". This is not as low a standard as most may think. LE will still need probable cause that there are exigent circumstances, i.e. something ticking like a bomb. I do not think a small package with gear would qualify under the new standard. Yes it does give the feds expanded powers for searching mail but I think it may not be that significant in our situation.
 
Well, a buddy of mine made some homemade moon-shine over the holidays. He sealed some in a plastic bag and put it in a fedex box to send to me. I know what you're thinking...moonshine...plastic bag = explosive. Nonetheless, Fedex took the liberty of opening the fucking box without his permission and told him he couldn't send it fedex.
 
the whole problem with this fucking bullshit is people do not see it coming but it is. we will be like russia people, watch and see, my 85yo neighbor says the same thing i do. look at what is happening, they are telling you you cannot smoke certain places, i don't smoke, and cannot stand smoke, but it's control, laws for seatbelts, i am a grown fucking man, paid for my car myself, if i want to wear a seatbelt that's my fucking buisness, im pissed right now, you got me going here, but they tell you you have to wear your fucking seatbelt in your own fucking car. kids and babies is a different story, but to ticket me and have the right to make a traffic stop is fucking communistic bullshit. also roadside checks are fucking communistic. it's fucking bullshit.

let me tell you this too while we're on this subject here. so everyone knows,

when stopped and been drinking you have the right to

1. not blow in a breathalizer, this is your right to NOT do this
2. not do roadside bullshit tests
3. keep your mouth shut and be polite but refuse these tests

they will threaten to take you to jail, if they are doing this, they are gonna take you to jail anyways, your already fucked, there is no talking your way out of it, they will continually try to persuade you to do these tests because these tests are their ONLY evidence to try to PROVE BEYOND reasonable doubt to a JURY that your guilty of driving under the influence. deny deny deny and tell them you'd be happy to perform the tests as soon as your attorney is present. you do not have the right to an attorney at this point in time but you do have the right to request it and to not give them incriminating evidence.

i'm telling you all this cause it could save alotta you from a dui and if you integrate this newfound knowledge into your brains, you'll figure other ways to protect your rights.

this was explained to my apprentiship class by a union brother who is now a full time lawyer and never loses cases. his main thing is dui's and keeping trained union guys with they're drivers' liscenses as to not waste union money trianing people and they lose their liscense.

Boy. Sure sounds like the presidency is becoming a dictatorship. Maybe he will absolve Congress and the Supreme court next.
