This may be a bit long.
I had a job in July that I quit after 4 weeks because they didn't follow the correct procedures they were suppose to. They didn't offer their employees lunch breaks, or any breaks for that matter, the ratios were totally wrong, the boss asked me to lie on some paperwork which I refused to do, and so much more. So finally I quit because I couldn't risk losing my license if something happened.
I told a supervisor why I was quitting and I let her know that it was the best thing in my situation because I was putting myself at risk. If I were to lose my license I would never be able to work in the same profession I am in. She understood or so she said. So then it was two days until pay day. I went to pick up my paycheck and it was missing some hours. So she called the big boss and told her, she says she will have it ready for me in the morning. I go in and no check. This vicious cycle of them promising my check will be ready happened for the past 6 weeks. Tonight I was ready to tell them I would see them in court if they didn't have my check ready. But to my surprise it was ready.
So I go pick it up. The big boss was there. She shoves the checks in my face while she tries to get me t o sign two forms. So I said thank you, grabbed the checks and sat them down so I could read what I was about to sign. I finish and she picks up the checks, shoves them at me and says bye. I walk out to my car and notice one check is in the amount of $165 and the other $200. They owed me pay for 70 hrs. @ a rate of $25.50/hour. I grab my calculator to see how much money they still owe me and I walk back in. I told her in a calm manner, that my supervisor calcultated the hours that I was not paid for and it came out to 70 hrs. I then said that there must be an error of some sort because I wasn't paid the full amount owed to me. She says I took taxes out because I will be charged taxes. Knowing she couldnt have taken out THAT much money for taxes I asked what percentage was taken out. She never answered. She then tells me, "I can pay you whatever I want to pay you." I was shocked! I said, "Excuse me?!". She told me she paid me at a rate of $6.50. I was like WOW! But I didn't say anything. I simply said I was paid $25.50/hr. She went on to say that all employees start at $6.50. I told her I could bring in my pay stubs to show what rate I was paid at. She then says I only worked there for a week. Which I said was irrelevant and corrected her by saying I was there four weeks. She grabs the checks which I had on the counter, shoves them at me and tells me to leave. I turned and said I guess you'll be hearing from the dept. of labor about this.
The thing is that I'm sure she didn't take out any taxes. She wrote the checks out to "Cash" not my name. Also don't they have to give you a form showing how much was withheld so that you can claim that on your taxes?
My question, is what she did legal? Can she pay me whatever she wants to? 19 of those 70 hours should of been overtime but then again they don't pay overtime, which I found out the week after I was asked to work overtime.
What can I do about this? Do I take her to small claims court or is there another avenue to get what I deserve in this case?
