have you ever gotten a ticket for this reason?

failure to keep to the right on a highway? i think i'll fight it. any experience or advice is appreciated.

No I haven't but I know some people who have. You will probably lose fighting it but may be able to plea down with the DA. It is a ticketable offense especially in some states.

i got pulled over today, shortly after leaving work. it happened on a 3-lane 'local' highway (the kind with traffic lights every so often, 50 mph speed limit, etc...). the highway was mostly empty, and i was driving in the left lane. i probably got in there to pass someone and didn't bother moving back. i even saw the unmarked car (with his flashing lights) cruising near me for a while (stopped at a light with me, etc...), but didn't think anything much of it because i'm oblivious to this law. eventually, the unmarked car moved into the left lane and 1 or 2 other cars in front of him got out of the way. i did the same, figuring he wanted to pass. but he followed me and soon enough i figured that he wanted to pull me over.

that's most of the detail i'm fairly certain of.
 
and i doubt it was that, ssme. i was going between 65-75. i wouldn't want to do any more than that while a cop is driving near me (and looking like he's out to catch someone, because he was pulled over when i first saw him and then started back into traffic at a slower pace (i.e., normal) than you'd expect to see from someone who can drive as fast as he wants) .

Kind of fucked up but you could be doing 100mph and if somone wants to go faster and you don't give up the right of way in the left lane you can be ticketed for impeding the flow of traffic.

As for you scenario you probably got ticketed for driving in a passing lane while not passing another vehicle. In other words you must make every effort to stay out of the left lane unless you are passing another car.

yeah that's strange, especially on a "highway" that has stoplights and you going the speed you said you were. at any point were there cars behind you or were you going the same speed as a car in the lane to the right of you?

you moved out of his way, too, to let him pass. i'd be pissed.

Unless you can prove that there wasn't enough room to move right then you are screwed. So basically you would need video because the court is sure as hell going to believe the cop over you. Go see the DA and try to plea down to malfunctioning vehicle or some other no point offense. You will have to pay the fine and court cost but your insurance won't increase.

hell man, i pretty much never leave the left lane now that i think about it....what a bunch of crap......one of those things that was implemented simply to create revenue.

i'm sure there were cars somewhere behind me and to the right as well, but not very close by, as if i were impeding the flow of traffic. i could be wrong, because i wasn't paying close attention to any of that. i honestly don't remember this law. i'm familiar with concept of a passing lane, but didn't know that driving normally could get you ticketed when the highway was low on traffic.
 
so this offense actually does put points on my license? i was wondering about that on the drive home, but i had hoped not, because that seems completely unreasonable (much like the law itself).

notice how calm i've been in this thread. oh well, at least life is good...oh wait, no it isn't.

is there the possibility of getting off on a technicality? something to do with the ticket itself, perhaps? i've done that with a parking ticket. the ticket this cop wrote is fairly messy. i wonder if he made a mistake somewhere.
 
i think in some states the law is the L lane can only be used to pass reguardless of weather or not someone is behing you??????
 
Was that in Jersey? I actually have never heard of anyone receiving a ticket for that without some other circumstance attached to it. Were you driving naked ?

It likely isn't worth fighting, and they will no doubt plead it down to something without consequence, other than court costs. It really doesn't matter, especially in these municipal courts. An attorney would run you five hundred and likely couldn't much more than plea it down either.

These appointed judges are chosen to bring in revenue

they've got those "left lane is for passing only" or whatever signs all up and down the PA turnpike. says something about it's the law or whatever. no signs like that on the portion of I-80 that i'm on all the time though.

doesn't matter much to me though, i'm usually in the left lane all the time passing others. came back from the philly area last saturday night with a dresser hanging out of the back of the Rustbucket (91 POS Blazer) going 80mph the entire way passing people left and right. this is normal for me. wait til i have a fridge hanging out of the back of the Rustbucket at the end of the month.

yes, my blazer is officially named Rust Bucket. i put the lettering on the hood myself :D
 
It's a real ticket if you were on a highway.

Officially the far left lane of a highway (2 or more lanes) is strictly for passing and not for traveling. It's a tricky one because some highways are so packed you really can't afford to keep a lane empty just to pass someone.

The highway - the only highway that one drives out to me is two lanes - if you stay in the left lane for several miles the Southampton cops or state trooper will ticket you.
 
while we're talking about tickets and new laws...

any other states have a manditory headlights on in work zones? PA implimented that 6 months ago or so, maybe longer, i don't remember. i guess if it saves one person's life, it's worth it. not hard to flip your headlights on.

every time i'm coming near a construction zone, i see those signs that look like they were written by a kid that says "slow down my mommy works here" or daddy and all i can think is well, if your parent has any brain cells, they'll stay out of the fucking road while i go past.
 
Did you get the ticket in a big city. If so, hire a lawyer for 55$ and the chances are the cop won't show up for court and the ticket will be dismissed. If if went down like you said, that cop sounds like an asshole.
 
You want out of the ticket do this. Ask for a jury trial. It totally screws with the da and the court but it is your right as a us citizen to have one. Usually the da will cop a plea with you for a little change and maybe a dd class but at least it won't go on your record plus the cop might not show to the jury trial either in which means nada you win automatically.

If you were hogging the left lane when you weren't passing anyone, then you deserve not only a ticket but a good thrashing as well! :)

Learn some lane etiquette.
 
i don't think i was hogging the lane. that implies that i was keeping others in the left lane behind me from passing. it's possible, because i wasn't moving that fast since a cop was right there. i usually don't cruise in the left lane if the other two are fairly clear. i suppose i didn't go back right fast enough for his taste.

learn not to make assumptions and be so self-righteous (that's my job).

and btw, if you think it's unreasonable to cruise in the left lane at 80-85, if someone behind you wants to go faster, you can fuck your impatient selves. granted, i will eventually move out of the way if there's room to my right and i'm not passing others. but if there is room, y'all can fucking go anytime you want. most people are selfish, impatient, lazy, and too demanding. that includes me. but if you think you have some inalienable right and reasonable expectation that one should move out of your way, even if you're both traveling at 20-30 mph above the speed limit, you are deluded. it doesn't matter what the law says. the law can be a joke. common sense + respect for the rights of others + perspective > law every fucking time. it's only because we often don't have all these things, that imperfect laws are necessary.

on another note, did you know that, according to NJSA Section # 39:4-128.4, you can be penalized for "Improper passing of a frozen dessert truck"? It's worth 4 points on your license.

edit: this may be a valid statute, if applied reasonably. i was thinking of passing on the highway, which doesn't make sense to me. but if on a local road, and passing while such a truck is stopped and kids may be around...that's a different story.

In other words, you still haven't learned diddly about lane etiquette. "If I'm already exceeding the speed limit, and someone wants to pass me, tough shit" is the wrong attitude, and shows a lack of consideration.
