Have I got a case to sue eBay?

I was a powerseller, brining in a lot of money a month, 100% legit. About 1 month ago i was suspended because they told me i had fake contact details up. This was a lie. They told me if i sent them proof of my contact details they would reinstate my account. So i faxed them over all my details. Yet that continued to say they were going to keep my account terminated. They have given no other explenation, and are now ignoring all my emails i send to them.

I understood that there was nothing i could do about this. However, I just checked my bank account and they have billed me $1500 on credit card for overdue fees. I am fucking outraged by this because when they suspend you, they send emails to all your bidders telling them not to follow through with the purchase. EBay has a thing where they reinburse sellers the auction costs if the buyer doesnt go through with the purchase. Unforuntately, you can not do this if your suspended. Meaning i have been billed hundreds of hundreds of dollars for transactions which did not even happen.

Has anyone here got any legal knowledge and know if i can do anything about this?
 
Had the same problem in the past. Don't pay the fees obviously and don't bother wasting your time trying to resolve the issue with eBay.

Open up a new account and start again but this time make sure you open multiple accounts so you have a backup if it happens again. It's a pain in the ass and you loose your feedback but it's a quicker solution to getting back on track than arguing with eBay.

they automatcially billed my account, so the money has already been taken out of my bank account.

Thats why im so pissed off.

They took the money out without any warning

If it was a major credit card file a dispute with them. They handle that end of it. I'm not sure how you would "sue e-bay", not an easy lawsuit and it's going to be contract issues (as in the contract you filled out and ok'd when you registered).. what it says, what they claimed you did wrong and how they can prove it, but I'm not sure where you'd even begin with a company on the web, you should review everything you go through when you register and maybe that can give you a lead. I can give you a website to find lawyers in your area www.martindale.com You can search by location and area of law. Good luck! I'd file the dispute immediately with my credit card.

The issue is that they charged me for transactions that never happened. So they have illegally taken more money out of my account.

I always found ebay to be a pain in the ass to deal with.

They always asked for more money..........then did nothing at all really.



Still though....ebay can rock if you play your cards right. Sucks at times though.
 
Does not sound like a strong case. To find out, you'll have to shell out $$$$ to an attorney to review Ebay contracts, agreements, etc. that are in place first to see if it wil be worthwile. Plus, your attorney better be better than the ones Ebay has and I am sure they have several. Don't waste your time and money, that's all my personal advice.

If they've sucessfully taken the money from your account then how can they claim you have fake account details?

Anyway, you will end up spending more on attorneys to uphold the contract and fix what went wrong then it's worth IMO. Winning money on a suit for distress, etc. is tuff and no attorney I ever met would take a suit like that on a contingency basis, they'd make you shell out a 5-10k retainer for their time and costs, w/o a guarantee on anything. contract law is contract law.

If it's true that they charged your credit card, file a dispute and re-register, easiest way to handle it. If they took it out of your account, not sure how they could have done that unauthorized, nevertheless, I'd call the bank and say it was unauthorized and find out just how they did an unauthorized direct withdrawal.

They over charged my visa and they told me its my bad luck because i am suspended and wont do anything about it.

Visa is a major credit card, you can file a dispute and they will start and investigation... Tell them it was an unauthorized charge.

Yes you can still dispute it thru most major banks and they will handle it just like a credit card account.

last i heard credit cards are done through banks - am i mistaken?

a day after deducting ~150 in fees
now I get e-mails informing me I have a credit balance for roughly the same amount
what to do?
