i'm a supporter of the death penalty, and i think the system allows way too much BS with appeals and delays and what not.
in cases where there isn't 100% concrete evidence (witnesses, admission of guilt, undeniable proof) there should be no delays in administering the death penalty.
in cases where there is a conviction on circumstancial evidence, i don't think the death penalty should apply. innocent men have been put to death yet the system says that the person got a fair trial and that's all that matters. it has happened before.
families of the deceased should have a choice in the death penalty matter as well. the family should get to choose between 5 minutes alone with the convicted person or the death penalty. you can do a lot of damage to someone in 5 minutes when they aren't in a position to fight back. an eye for an eye....

Good post Crak600. Unfortunately, this was a case in which there was not 100%substantial/concrete evidence. Even the judge imparted his .02 by removing the two jurers leaning towards innocence. If there was ever a case in which an appeal is justified....this is it. Everyone has a right to have their day in court and if they don't like the decision....they can appeal it.
Personally, if the verdict is upheld on appeal he should get the death penalty. There was a child involved ..... and that's just plain wrong.
Why don't we simply make him an organ donor? China has the right idea for their hard-core criminals!

but the whole 5 minutes alone thing, i think if the convicted person lives, they should be allowed to go free. i don't think i'd try to kill the person, just completely disfigure and cripple them so they live a lifetime of agony and pain.
