The RIAA (Recording Industry Ass. of America) is being sued by one if the victims of the RIAAs criminal activities.

This is the case peer-to-peer file sharers have been waiting for. Tanya Andersen, a 41 year old disabled single mother living in Oregon, has countersued the RIAA for Oregon RICO violations, fraud, invasion of privacy, abuse of process, electronic trespass, violation of the Computer Fraud and Abuse Act, negligent misrepresentation, the tort of "outrage", and deceptive business practices.

Ms. Andersen's counterclaims demand a trial by jury.

the RIAA is fighting a rearguard action where theyd rather bleed relatively little through lawyers, stomping on people along the way, than face an accellerated change in the music distribution model that has guaranteed them billions for the past half century

this lady is going to be in court for a long, long time. i mean, good luck to her, but regardless...theyre going to try and spend her to death, tobacco company style
 
It could be adequate for everyone else being sued to demand to await the outcome of this case thus effectively tying up all future RIAA suits.

I can see a lot of riders on this suit as interested parties. RIAA has been pretty heavy handed with this and it will bite them in the ass if it ever gets to a jury. The business model of the recording industry has been flawed since its inception.

exactly, juries tend to not sympathize with big corporations in cases like these.

I hope she wins, the RIAA is out of hand.

She'll be OK on this; there is a lawyer looking to make a name for himself who will take this case, no doubt. As others have said, the case could prevent the RIAA from pursuing others.
 
If this lawyer prevails --- he has just secured bank for the next few years.

He'll keep signing up new victims, processing the same paperwork -- and throwing the book at the RIAA.

Of course, 90% of these will just "settle" quietly -- which rewards the lawyer generously for his effort pursuing this. The RIAA doesn't want to lose a case and set a precedent.

Gerat biz plan.
