DUI question

Talking to a bud of mine last night, he got a DUI, but the kicker was he wasent even driving. He was riding with someone,when the cops pulled them over the /driver/ jumped in the backseat. When they pulled them both out of the car they arrested him and when he told them he wasent driving the cops said they didnt care as long as they got someone.
So will the cops have to prove he was driving for it to stick? Does he have any way out of this or is he SOL?

No shit. People don't realize it but cops can see what your doing if your hiding shit, etc. when getting pulled over.

Must have had window tints @ night or something for them to miss that.

yeah it was the other guys car. Cops are so stupid. the owner is in the backseat, the drivers seat is empty, and they cant put two and two together.

and yeah i cant phatom how they didnt see the switch-a-ro. plus
i thought they had cameras in the cop cars.
