DNP legality

I've heard conflicting stories such as capped DNP being illegal and strictly powder uncapped being acceptable. Can anyone clear this up?

DNP is classified as a chemical. It is not FDA-approved. And it is not supposed to be for human use. As everyone knows, it is widely used in insecticides. DNP is also classified as Hazardous.
