Discriminations for being overweight?

Well, I have to go to court tomorrow....

I recently terminated the employment of one of my employees....and he in turn is suing the company for discriminating against him because he is seriously overweight. Actually, it is really quite sad, since this man has let himself go for so long, he cannot even walk 100 yards without sitting down to rest and being totally winded.

This man was unable to meet the basic expectations of the job...in areas of quality and efficiency. He was given over 6 months time to improve his performance and I also provided him special training and job coaching to help him met these goals. Luckily for me these things are all well documented...

Do you feel that special considerations should be made on the job to accomodate the obese? Or do you feel that you treat those that are seriously out of shape diferently?

Fuck him. People ae cut to much slack nowadays, everyone has an excuse. If his weight interfered with his job performance, he should have dealt with it. Oh wait, it was out of his control. It was his sluggish thyroid that was making him sit around and ram twinkie after twinkie down his neck.
 
I don't think accomodations should be made at the job because of his inability to fulfill the expectations because of his obesity, no.

I do not treat someone who is obese any differently than someone who is not.

I think the gentleman should have realized that his obesity was the prime reason he was not able to do his job correctly....and in turn, that resulted in his losing his job.

It is not your place, as an employer, to keep your employees at a healthy weight, is it??? I didn't think so.

Too bad that the company may have to suffer because of this mans laziness.
 
People are looking for reasons to sue now days.

As long as you have documentation you should be ok.


Should they receive special treatment?

No, but I'm sure some court somewhere will say otherwise.:(
People want to blame others for everything that goes wrong in their life, when they need to look at the person in the mirror.
 
When he filled out his application, did he fill out anything in the disability field? Did he let you know that he had a disability that would interfere with being able to perform the tasks needed for the job?

He was a fat piece of shit when you hired him. If you were discriminating against him, just for the sole fact that he was a fat piece of shit, you never would have hired him in the first place. That alone shows you don't hire against people that sit down and eat Twinkies all day.

yeah fuck that guy. if you gave him an ultimatum to improve his PERFORMANCE which meant getting his ass in gear and up to par per your company's requirements to work there, then you covered your ass legally. that is just total bullshit. this happened to some co worker at my last job, where the management didn't have the balls to let go of this one guy because he had health problems, a reported back injury that prevented him from lifting anything over 15lbs(he didnt do shit in the first place), and just plain had health problems. I am all for letting go of the dross of a company. there is no need to keep the weaklings that just get by in the company, no matter how long they have been there, or how good of friends they are to everyone. bullshit. if they don't meet the requirements, perform poorly or not at all, see ya. that is malingering on his part, btw
 
This is your best bet: :chesty:

Learn how to use it first, sucks to miss and only maim someone. Then they sue for sure. Be sure to hit them at least 4 times unless you are using a high powered rifle. There are very few survivors when the bullet is successfully placed between the eyes.
 
I don't think that people should be discriminated against because they're overweight...but I don't think that standards should be lowered to accommodate them either.
