Cited for illegal window tint, trial tomorrow

I was cited for having window tint of 17% light transmittance. State law is 35%. My vehicle passed inspection 6 days prior to the citation. The cop stopped me for nothing else, just the window tinting. He had a light meter which he did not use properly. He didn't clean the glass before he used it and he only took one reading. The instructions say to clean the spot on the glass first and also to take more than one reading to make sure the results are consistent. This trial is in Magistrate court so I'm sure it's going to be a joke. Magistrates here are elected officials. They don't have law degrees. I'm sure I'll be convicted and have to appeal it to the circuit court. Damn cops, don't they have anything better to do.
 
If I had anything other than factory tinting I'd keep my receipt in the car showing what transmittance I paid for.

I've already been doing that. I went to a yuppie bar last weekend and the ladies were all over me when they found out I was on "trial" this week in criminal court. :)
 
I miss my illegal tint, it was completely black you couldn't see a thing, I loved it. My friends were a little uneasy when I picked them up though. Very slowly..approaching..the..vehicle.. lol.

And I did have one guy jump halfway in my car when I was pulled over on the street once scaring the hell out of both of us before he realized he had the wrong car.. :eek2:

Anyway, fasttwitch, that sucks.

It's not a "rice" car. It's a Chevy Cavalier that I bought used. The window tint was on it when I bought it. It's passed state inspection for 4 years straight.

D'oh! When a friend of mine got pulled over, the cop just took the lighter to the tint.. uncool eh? Melted it and ruined it. I was lucky I guess, just a warning.
 
Man what a whipping that's gotta be. Not only do you get to pay the fine, but won't they make you give some sort of proof that you had your windows retinted(i.e. even more $$)?
Where do you find places to do illegal tint? Can you go to your average window tinter and slip them extra money to go darker than legal? I've always just gone with the darkest I can get legally. I like walking the line between being an outlaw and a good citizen. I wouldn't live my life any other way.

That was destruction of property.

My issue is that my tint IS LEGAL. All of the mechanics at the inspection stations have approved it. I've watched them check it.
 
I have been ticketed many times when I had tint. I always agreed to everything and played dumb, saying "Yes officer, I will take the tint of first thing in the morning myself." fuck it.... I was not taking anything off. I still think if they are legal to sell this tint at car shops in New Jersey, where I live, go after them for selling it, not me for buying and using. Besides, I have seen way to many of the same cops with it on their own personal cars and trucks, tinted to the max. If they can have it, I can.

Unfortunately, you will just have to pay the ticket...small price to pay. It does suck. Double standard...

I have dark ass tints on my car and have never been pulled over for it....everyone in this area of jersey does..the cops would have to pull over eveery other car.

make sure when you go to court that you have your inspection details detailing the tint approval. if you make a statement afterwards you can make the cops life difficult (only fair) since it sounds like he ws a dick about it

i used to have my car registered interstate for just this reason (im from the tropical north, we can have very very dark tint, as opposed to the temperate climate i was living in, where you were flat out using yellow cellophane legally. i just left the tropical numberplates on (for,oh, 5 years ;) ) and the only time i did get asked about it, i was 'on holiday'

OK, verdict in. I was found guilty. The cop perjured himself and the magistrate was an old geezer that I doubt even knew what anyone in the court room was talking about.
First, I had a copy of the instruction manual for the tint meter. The cop explained how he graped the glass with his thumb and forefinger to hold it steady. Step 1 on the instructions said to clean the glass first. He didn't clean the glass. I pointed out that he failed to clean the glass and he replied "I cleaned it by rubbing it with my thumb and finger" WTF! How does that clean the glass? That just makes it more dirty?

I mentioned that the officer had no probable cause to make the traffic stop since he can't tell the percentage of light transmittance with his eyes. I said this was in violation of the 4th amendment to the constitution. The magistrate said, "Son, the constitution don't apply to this court".

The cop said that my visor on the front windshield extended below the ASI line. However, my windshield does not even have an ASI marking. I asked the cop "Are you sure that you saw an ASI line?" He responded "Yes". I then pointed out to the magistrate that my vehicle didn't have this line and asked if I could enter my vehicle into evidence. He said "NO, We don't have time". I also argued that there are no statutes allowing the use of light meters as a law enforcement device. The prosecutor told the magistrate that the statute did allow it and handed him a photocopy of the law. I asked what section stated the tint meter was an allowable device. He pointed to a section that stated that manufacturers of window tint film must affix a sticker indicating the % of light transmittance. What the hell did that have to do with light meters? I then asked the prosecutor to indicate exactly where it said light meters were admissable. He said "I'm not going to read it but it's in there". Well, it wasn't in there. The magistrate refused to even read it.

Get an attorney and sue. In the mean time, find out who the trouble shooters are for your local paper and news stations. Make this painful for them. ;)
 
I agree....I would make noise on this one. Maybe you can get some kind of support from tinting businesses.
 
The worst part about it is the magistrate is a former cop that got fired for making a racial slur to the victim of a hate crime. There was a white girl dating a black guy and someone burned a cross in their yard. This magistrate at the time was a Lt. on the city police. He was sent to investigate and told the father of the victim (the girl) that "If my daughter was dating a nigger, she'd already be dead." Can you believe this guy said that and still got elected? He's up for re-election next month and I'm going to do my best to remind the voters of his past misdeeds.
