Here's one for you guys, i was pulled on a motorcycle for "irratic" bahavior while setting at a red light. Eyes dialated, shaky, had some bad reactions to something i was taking(non illegal) but i was fine and if i was so fucked up how the hell was i riding a motorcycle???. I passed sobriety tests, they called ambulance anyways and i was taken to hospital for blood tests which i all passed, no charges filed at any time during this, before ambulance or after. My motorcycle got towed off as i was getting in ambulance which i didn't even want to do, they made me. They searched the "trunk" of my motorcycle which you have to get off the bike, and open it with a key, they then searched everything there, inventoried it, took my bike, found my receipt for my motel room. and what room i was in

now here is where it gets even better, the called that hotel and the owner searched my room on the fact that a cop called and told her i was on LSD, plus i had 1300.00 cash on me i guess they thought i was a dealer, she searched my room and deadbolted it. When i got back from hospital, paid to get my bike out, and then had to wait on cops again for the lady to un bolt my door. No charges, nothing found, and im stuck with a ambulance bill and emergency room visit bill, over 500 bucks....hows that for the police fucking someone and to my suprise they told me that hotel was the owner's private property and she could search it at any time without warrant

I can't remember offhand... but I remember a case where the police had a landlord search the apartment... who found some items... the truth is, the landlord (to renters and I THINK hotel guests) doens't have the right to give consent to search the apartment/room... if he does, and things are seized... they would probably be excluded... however, you'd probably lose your contraband.

Let me see if I can't find that case.

no, i doubt i get flowers, just the fucking 500 dollar bill....complete bullshit, anyways, its over and done now, but imagine if they found say two of my friends cocaine, GHB, my steroids, growth, etc etc and the room was in my name, hell it would cost me 10,000 bucks to rid myself of charges, and maybe still go to jail

Absolutely not. The landlord has no right to give consent. A motel owner also has no right to give consent. If a spouse cannot give consent to search a non-common area then there is no way that anyone else can give consent to search. Also, if they went into a locked compartment on the bike before it was being inventoried then that also is an illegal search.

If I were you I would call a lawyer and immediately file against the police department and the Motel. If you don’t then all I can say is it’s your loss.

well, it may be my loss, but i think that a lawsuit would cost me more than i may get. THis was at a VERY crowded beach on eastern USA, and the police said to me that the lady owned that hotel(small one) and that it was her property, i never signed any kind of lease or anything else and that she had the right to go in there whenever she wanted. Fucked up i know, and they may have completely misinterpreted the law, but hell its over now, just another example of how they do what the fuck they want no matter what the law says. Plus the locations is 5+ hours from where i live and it would be too damn much trouble. Just advice to everyone, when on vacation, keep your "illegals" stored safely, you never know.....

Where were you New Jersey? A landlord cannot consent to a search by the police because the tenant possesses the property according to the terms of the lease. A hotel/motel is different. You do not have a property interest in the hotel room -- more like a license I would presume.

if you were at myrtle beach s.c. it all makes sense. ive known atleast 10 people who have been there on vacation and been harrassed by the police and occasionally thrown in jail with a huge fine. this is a money maker for this town especially when the weather starts warming up. i wont go there again. i got pulled down there cuz cop said i was speeding and all of a sudden he pulls me out of my truck and asks me where im hiding the syringes at. searches my car and finds nothing. hes over there with his dick in his hand and one pissed off big mofo(me)wanting to kill him. nothing i could do though.
