Being sued by the cable company

Has anyone else ever been sued because you bought a descrambler? My mother is being sued because of a box she bought 7 years ago. This fucking sucks!!!!!
 
Holy shit. That sucks! I was going to buy a descrambler but it's not worth it if they're willing to sue over it now.
 
well, if you do buy one, get it from ebay or something, never buy from an ad and NEVER use a credit card or check, only money orders or straight up hard cash

no...we're being taken to court. I received the files today. She has to go and register with the court clerk within 20 days. Well the way they found out was this: Cable Box Company was busted for selling illegal boxes (who doesn't), they seized their records of like...over 100,000 people that bought them. So since she paid by check they could trace it directly to her.
 
I see it like this...A friend told your mother about the company, it sounded like a good idea, she bought one, it didn;t work, she tried to send it back for a refund, they said no way...she threw it away...case dismissed....unless they saw it in her house.

That's exactly what I thought, Ranger. That they had to have hard evidence such as video footage of you with the box on watching an illegally descrambled channel. It's funny because I know 3 other people that are being sued from my town. So Ranger, did you know someone personally that this happened to? Or is this something you read
 
Owning a descrambler is perfectly legal as long as you don't use it to receive any channels that you aren't paying for. To win theit suit they will have to prove that channels were received without payment.
 
The cable company will never be able to prove their case plain an d simple.Just as one person said the burden of proof is on them and unless they have a tape of you watching channels you did not pay for than they are out of luck.This is a scare tactic and they will in the end have to pay you for your court fees and you can in turn counter sue them for the putting your name through the mud because of some trumped up charges. GET THEM.....$$$$
 
PE I have been to court several time due to my old work profession about people stealing electricity, but cable theft was there also...Most of the time the judge ruled against the cable company unless a company official was in the house and saw the illegal box(hooked up and working)....most of the cases were hearsay and not allowed....alot of these folks got busted due to an ex-gf, an ex wife or jealous neighbor...

Being in possesion of a descrambler is all that's needed.

Actually, all that's needed is evidence that the signal resistance was greater going into the house in question.

But that could be hard to prove. She can go into court and say she heard about a company to get a cable box from because she wanted cable in her bedroom on her non-cable-ready TV and she got it in the mail, the box never worked and when she tried to contact them for a return they wouldnt take her phone calls.

If you havnt already done so, get the dam box out of your house!

This is actually an easy thing to beat in court, she might want to get a lawyer (if you have a family friend that works in law that will work just fine). In most of these 'small' criminal courts if they see you show up with a lawyer then in their minds they are going to almost always rule in your favor just because they want to avoid being there all day and wasting tax payer money on someone who had a $200 cable box.

Oh it's easy to beat.
But no way in hell are you going to get any money back in court fees or have a chance of some type of counter-suit.

Well, I do feel a little better now :) But it's just going to take a big bite out of our pocket to take care of this...fucking greedy ass companies!!
