Nope. They are legally women after they have the operation. Basically in the eyes of the law it's:

penis = man
vagina = women
penis made into vagina = woman.

A lot of them are born with an extra chromosome which makes them bi-gendered.

Although they may have a dick they feel like they should be a woman and at puberty start developing breasts so they are basically caught between the two genders then they decide to take hormones to be female.
