they went 2 break ground on my house and it wont fit on the lot?

TO STEP UP IN LOT SIZE THE $$$ PISSES ME OFF, I'D RATHER PUT IT IN THE HOUSE!

Who approved the site plan?

You can't break ground without an aprroved site plan - therefore whoever approved the plan is who you need to see.

It should be covered under their E&O ins.

Is this a sub-division? If so is it a builder's sub div?
 
yeah a builder's sub div.

THey want to try and make it "fit" now. grrrr. I dont want my house squeezed onto a lot - and have a tiny ass yard. However, I have to make every dollar stretch too ya know, I'm not rich.

I dont know what I will do. :(

This could be cake.

The house - is it one of their "typical models" that they build?
Did you pick one out of say 5/6 styles?

And then pick out your lot?


Work with a salesperson, their architect and the "color" person to select your interior elements?
 
yes, we made adjustments to a production home....but yes we did.

as far as color people? I have no idea what that is but everything else yes.

Have meeting with the salesperson and the architect - ultimately all the sites have already been reviewed as to which house can fit onto which lots and the sales person is already aware of this before they sell you.

Sometimes they flip the house (left/right mirror image) to make it fit but all these adjustments are discussed before the house & plot is up for sale.

Now when you alter the house and change the footprint of the house (like add two feet to over all depth or width of the house) it is the responsibility of the building company to file the new site plan to make sure all the set backs are straight up.

You have the right to be firm about it and depending on the changes they have to make (although inches could be something you won't notice) to fix the envelope you could tell them you want a land upgrade at their cost.

(The color people are the ones that let you select from almond, bone or white fixture in your baths and kitchen, your carpet, wood choices, stone & tile, blad,blah,blah and of course your "extras" bill - who does it and what their title must vary.)

Do you think that they would????? If we were firm enough? eeek!

So the package wasn't direct from a builder and a salesperson that works for the builder?

A real estate agent brought you to the builder or to a saleperson that works for the builder?

I would go back to the person that did the original alterations on your house and just ask how could you not know that the house would exceed the building envelope? (Again if really is a matter of an inch or two you won't notice the resizing)

Also is it the footprint of the house that doesn't fit or is it the height/air space of the roof encroaching?

What state are you in, btw?

Its the actual house, its too wide I guess - I live in Missouri.

I think resizing is a great idea, but Johnny (hub) is upset I guess about the whole situation. He says if the lot cant fit our house it must be way too small and he does not want to crowd our house on a small lot. ? Our house is not big. I dont know what they plan to put on that lot then, considering our plans are one of the smaller houses in the neighborhood.

I plan on doing this, the house we live in now is about to sell. They should have broke ground a long time ago, and now I will probably have to rent.

You should be able to get a site plan which is a layout of the shape of your property and how your house sits on the property if you were a bird looking down.

The house is probably hitting the set backs but with the site plan you should be able to see what sort if front, back and side yards you should have.

It's all public information so there should be no reason why they can not get this to you.
