A Visit From U.s. Customs

My bro called last night and said he had a visit from U.S. Customs. They informed him that they took his name from a list the had confiscated. He had made an order from a person who was busted several months ago. He admitted nothing. They told him he could either be a part of the prosecution or a part of the defense. Couple of questions: Can they file any charges for his name being on a list? Does he need to contact an attorney right away? Steroidlaw.com is no help. Can they detain you for being in possession of a fina kit? Need some responses as we don't have much time. Thanks

they can't prove he ordered and more importantly recieved, then he should have no troubles. He also shouldn't have any issues with the fina kit, although in some states its illegal to posses needles without medical reason, which are included in the kit. Personally I wouldn't say shit if I were him. He can always change his mind after he sees what will happen if he doesn't join the prosecution.

If they had enough info on your bro. They would have charged him for a crime. NOT give him the 3rd degree good/bad cop scenario.

They need to prove that he bought stuff from the guy. Exchange of $$ for product. Since they can't do that, they have no case against your bro.

Its like all of these middle eastern guys rounded up since Sept 11 and haven't been charged with anything. But if they say they knew something about Sept 11, then they will be set free. Yeah, right, they will be charged for knowing about the plot and doing some time or get deported.

Sorta like you and your friend committ a crime . They put you in 2 different rooms to be questioned. The cop tells you, your friend in the other room says you shot the guy , while he watched. So you are pissed and call bs and rat your friend out. The whole time the cop was lying to get to the truth.

DAMN COPS are so dirty....

Good and bad....

First, being on a list is incriminating, but not conclusive for anything to stick. So, a clean house and going without gear for a little while is in order. Just in case they get a sympathetic magistrate/judge to issue a search warrant that holds up. Good news is that it likely isn't enough to get a warrant without something more.

Second, the prosecutor can charge you with anything he wants. If it goes anywhere is dependant on the worth of the claim made (a groundless charge would be dismissed on a pre-trial motion and probably get the prosecutor chided by the judge for wasting taxpayer resources). Most prosecutors want enough of a case to warrant bothering with it, but they might make empty threats on a weak case hoping for a plea bargain to a lesser charge thinking you will agree out of fear of what they might know.

Third, the "cops" do try to intimidate you into making comments and "cooperating." You have no duty to do either. Secure an attorney who would represent you in this matter who you can call IF you ever actually get arrested or pulled in for questioning. Don't cooperate by talking to the cops. If brought in for questioning (even if they call it an interview), insist on your lawyer being present. If they say he's not needed, go ahead and leave--this is the test. If you are free to go at will, it is only an interview and you don't have to talk to them. If they won't let you leave, it is an interrogation and you have a right to a lawyer. Either way, you win.

IF YOU WERE TO CHOOSE TO COOPERATE, HAVE THE PROSECUTOR GIVE YOU IN WRITING "TRANSACTIONAL IMMUNITY." This means you can't be charged for any offense regarding the matter. What most prosecutors try to give is "USE IMMUNITY." That only means they can't use anything you admit to in court against you (or likely to build a case against you). However, they can still prosecute if they find other evidence to build the case. Use Immunity is enough to negate your 5th Amendment right against self-incrimination.

i agree with the above replies, they have no definitive information to use against you. my name and email address is on tons of porn/sales/etc lists that i never signed up for, but i get emails every day from them.

my question is why would customs be knocking on his door if the source was domestic? (im assuming domestic as he was busted). wouldnt that be dea ?
